220

~Ms. Kathelene Jones favored standard street signs,
paved roads, and requested a guarantee that the realtor
fulfill promises made to buyers.

Mr. Ben Mayberry favored immediate enactment of the
Ordinance. It was Mr. Mayberry's desire that developers
of existing subdivisions be required to fulfill promises
made to buyers.

Commissioner Milloway asked if the Subdivision Or-
dinance was retroactive to include existing subdivisions.
Mr. Jack Alston, County Planner., stated that Ordinance
regulations would apply only to those platts which had not
been recorded prior to adoption of the Ordinance.

Mr. E.H. White requested a rule that realtors be re-
quired to file with the Planning Commission before they
are allowed to open their subdivisions.

Mr. Manuel Kiser asked for the definition of a "sub-
division". Chairman Hawfield read the definition from
the proposed Ordinance. Mr. Kiser questioned land which
was owned by one person who decided to divide his land and
give it to his heirs. Mr. John Boger, County Attorney,
stated that this was a question of "purpose of sale" and
would have to be decided upon by the C0u~ts. Commissioner
Milloway questioned if this would not set a precedent.
Mr. Boger answered that the Commissioners would make de-
cisions on each case based on "its own merit".

Chairman Hawfield commended the Planning Board

and the Advisory Board for the excellent job that they
had done in preparing the Ordinance and recognized Mr.
Dave Roberts, Engineer for the Cabarrus County Health
Department, for his work with both Boards.

In response to a question concerning replacement

or up-keep of non-standard signs, Mr. Alston stated that,
if money is appropriated, then non-standard signs will
be replaced by standard signs when the non-standard signs
need to be replaced.
