The Board of Commissioners for the County of Cabarrus, <br /> <br />North Carolina met in regular session at the Courthouse in <br /> <br />Concord, North Carolina, the regular place of meeting, on <br />Thursday, October 5, 1978, at 9:30 A.M. <br /> <br />Present - Chairman: S. Glenn Hawfield, Jr. <br /> <br />Commissioners: <br /> <br />Robert A. McClary <br />John A. Hammett <br />Marcelle Milloway <br />Troy R. Cook <br /> <br />The invocation was given by Reverend Weldon Madren of <br /> <br />the New Gilead Reformed United Church of Christ. <br /> <br />The minutes of September 7, 1978, were corrected to <br /> <br />read: <br /> <br />"September 19, 1978" in paragraph one on page 215. <br /> <br />UPON MOTION of Commissioner Cook, seconded by Commis- <br /> <br />sioner Hammett and unanimously carried, the corrected minu- <br /> <br />tes of September 7, 1978, the minutes of September 19, 1978, <br /> <br />and the minutes of September 28, 1978, were approved. <br /> <br />UPON MOTION of Commissioner Hammett, seconded by Commis- <br /> <br />sioner McClary with Commissioner Milloway abstaining, the <br /> <br />Board voted unanimously to adopt upon first reading the fol- <br /> <br />lowing ordinance: <br /> <br />BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF CABARRUS <br />COUNTY, NORTH CAROLINA, that the following ordinance be <br />adopted: <br /> <br />1. Short Title. <br /> 1.1 <br /> <br />Short Title: This ordinance shall be known <br />as the Cabarrus County Cable Television <br />Ordinance. <br /> <br />2. Intent. <br /> 2.1 <br /> <br />Purpose: It is the purpose and intent of <br />this ordinance to provide for Cabarrus <br />County a cable television system which <br />will serve present and future needs of the <br />citizens and general public of Cabarrus <br />County, government, public institutions, <br />commercial enterprises, and lawful public <br />and private organizations. Said system <br />in its establishment, construction, opera- <br />tion, maintenance, and regulation shall be <br />subject to and in compliance with the terms <br />contained herein and the franchise agree- <br />ment referred to herein, and all pertinent <br />laws, rules, regulations, orders, and <br />policies of the Federal Communications <br />Commission, the State of North Carolina, <br />Cabarrus County and all governmental <br />agencies having jurisdiction over the same. <br /> <br />3. Definitions. <br /> 3.1 <br /> <br />General: For the purpose of this ordinance, <br />and unless the franchise agreement otherwise <br />requires or a different definition appears <br />below, the terms used in this ordinance shall <br />have the meaning ascribed to them in appli- <br /> <br /> <br />
