When not inconsistent with the context, words used in the present tense include the future, words in the plural number include the s:[ngnlar num- ber, and words in the singular number include the plural number. The following definitions shall be used in 'interpreting this ordinance: "Access Channels" shall mean those channels required by Federal Communication Commission regulations which, by terms of this ordinance or the~ franchise agreement, are required to be kept available by the franchisee fo.r partial or total dedication to public access, educational access, local government access or leased ~ccess. "Cable Television. System" shall mean any system which operates for hire the service of receiving and ampli- fying programs broa'dcast by one or more television and/or radio stations, and any other programs origin- ated by a cable television company or by another party. and distributing such programs by wire, cable, micro- wave or other means to persons who subscribe to such service. Such definition does not include: ( a ) (b) Any system which serves fewer than fifty sub- scribers; or Any system which serves only the residents of one or more apartment dwellings under common owner- ship, control or management and any commercial establishment located on the premises of such apartment complex, and any hotel or motel complex and any condominium development, and ~which trans- mits only signals broadcast over the air by stations which may be normally viewed or heard locally without objectionable interference, and which does not provide any additional service over its facilities~ "Countyj' shall mean Cabarrus County. "Boar~ of Commissioners" shall mman the present govern~ lng board of Cabarrus County or any future board con- stituting the governing body of the County. "County Manager" shall mean the County's chief admin- istrative officer or any designee 'thereof. "Converter" shall mean an electronic device used at a subscriber's terminal, which converts signals to a frequency not susceptible to interference and distor- tion within the television receiver of a~ subscriber, and by an appropriate channel selector also permits a subscriber to view all delivered .signals at designated dial locations. "Franchise" and "Franchise..~.~ree~ent" shall mean autho- rization granted pursuant to the terms of this ordinan- ce to construct, operate and maintain a cable televi- sion system within ali. or a specified area in the County. The franchise shall be granted in the form of a franchise agreement which is s~parate and distinct from any license or permit required for the franchise ordinance, and together with this ordinance shall con- tain the terms and conditions upon which ~ cable tele- vision system may be operated in Cabarrus County and the privilege of transacting and carrying on business within the County as required by other ordinances and laws of the County.
