When not inconsistent with the context, <br />words used in the present tense include the future, <br />words in the plural number include the s:[ngnlar num- <br />ber, and words in the singular number include the <br />plural number. The following definitions shall be <br />used in 'interpreting this ordinance: <br /> <br />"Access Channels" shall mean those channels required <br />by Federal Communication Commission regulations which, <br />by terms of this ordinance or the~ franchise agreement, <br />are required to be kept available by the franchisee <br />fo.r partial or total dedication to public access, <br />educational access, local government access or leased <br />~ccess. <br /> <br />"Cable Television. System" shall mean any system which <br />operates for hire the service of receiving and ampli- <br />fying programs broa'dcast by one or more television <br />and/or radio stations, and any other programs origin- <br />ated by a cable television company or by another party. <br />and distributing such programs by wire, cable, micro- <br />wave or other means to persons who subscribe to such <br />service. Such definition does not include: <br /> <br />( a ) <br /> <br />(b) <br /> <br />Any system which serves fewer than fifty sub- <br />scribers; or <br /> <br />Any system which serves only the residents of one <br />or more apartment dwellings under common owner- <br />ship, control or management and any commercial <br />establishment located on the premises of such <br />apartment complex, and any hotel or motel complex <br />and any condominium development, and ~which trans- <br />mits only signals broadcast over the air by <br />stations which may be normally viewed or heard <br />locally without objectionable interference, and <br />which does not provide any additional service <br />over its facilities~ <br /> <br />"Countyj' shall mean Cabarrus County. <br /> <br />"Boar~ of Commissioners" shall mman the present govern~ <br />lng board of Cabarrus County or any future board con- <br />stituting the governing body of the County. <br /> <br />"County Manager" shall mean the County's chief admin- <br />istrative officer or any designee 'thereof. <br /> <br />"Converter" shall mean an electronic device used at a <br />subscriber's terminal, which converts signals to a <br />frequency not susceptible to interference and distor- <br />tion within the television receiver of a~ subscriber, <br />and by an appropriate channel selector also permits a <br />subscriber to view all delivered .signals at designated <br />dial locations. <br /> <br />"Franchise" and "Franchise..~.~ree~ent" shall mean autho- <br />rization granted pursuant to the terms of this ordinan- <br />ce to construct, operate and maintain a cable televi- <br />sion system within ali. or a specified area in the <br />County. The franchise shall be granted in the form of <br />a franchise agreement which is s~parate and distinct <br />from any license or permit required for the franchise <br />ordinance, and together with this ordinance shall con- <br />tain the terms and conditions upon which ~ cable tele- <br />vision system may be operated in Cabarrus County and <br />the privilege of transacting and carrying on business <br />within the County as required by other ordinances and <br />laws of the County. <br /> <br /> <br />
