232 <br /> <br />6.3 <br /> <br />Extension of Service: The franchisee may negotiate <br />with any citizen or group of citizens outside the <br />corporate limits for the extension of CATV service. <br />Service may be extended to areas outside the cor- <br />porate limits provided there is no deterioration of ~ <br />service to citizens inside the corporate limits <br />that results from such extension, and provided all <br />residents of the County have service available if <br />they desire it. Negotiations for extension of service <br />shall in no way result in any change in rate schedules. <br /> <br />6.4 <br /> <br />Basic Service Area: The franchisee shall provide <br />its service to residents of the County in areas where <br />the density of dwelling units is equivalent to or <br />greater than the rate of forty (40) homes per linear <br />mile. The franchisee shall extend its service to <br />such areas and only the standard installation charge <br />specified in the rate resolution will apply in such <br />areas. Special installation charges may be made <br />where the rate of dwelling units per.'~miles is less <br />than the equivalent of forty (40) dwelling units <br />per mile; provided, however, that such special charges <br />shall not exceed the direct cost to the franchisee <br />of such installation,. Decisions over provision and <br />extension of service by the franchisee as well as <br />charges may be appealed to the County Manager. <br /> <br />Regulation of Rates. <br /> 7.1 Franchise Fee: <br /> <br />(see "Payment to the County'?, Section <br /> <br />7.2 <br /> <br />Limitations on Rates: The charges made to subscribers <br />for services of the franchisee hereunder shall be <br />fair and reasonable and no higher than necessary to <br />meet all costs of the service (assuming efficient <br />and economical management) and provide a fair return <br />on the original cost, less depreciation, of the pro- <br />perties devoted to such service (without regard to <br />any subsequent sale or transfer price or cost of such <br />properties). The franchisee shall receive no con- <br />sideration whatsoever from its subscribers for or <br />in connection with its service to its subscribers <br />other than in accordance with this section, without <br />approval of the Board of Commissioners. The franchisee <br />shall not charge rates in excess of the rate schedule <br />appearing in the franchise agreement. <br /> <br />7.3 <br /> <br />Adjustments to Rates: Initial rates and charges shall <br />be fixed in the franchise agreement. Thereafter, <br />The County or franchisee may request rate adjustments <br />at any time. After a public hearing affording due <br />notice to the franchisee and other interested persons, <br />the Board of Commissioners may adjust rates, In no <br />event shall rates be changed without Board approval, <br />except that nothing in this provision shall prohibit <br />the reduction or waiving of charges in conjunction <br />with promotional campaigns for the purpose of attract- <br />ing subscribers. <br /> <br />7.4 <br /> <br />Refunds to Subscribers and Users: If any subscriber <br />terminates any monthly service during the first six <br />(6) months of said service because of failure of a <br />franchisee to render the service offered, the franchisee <br />shall refund to such subscriber an amount equal to <br />all charges paid by the subscriber during the period <br />in which no service was received~ <br /> <br />If any subscriber terminates for any reason any <br />monthly service prior to the end of a prepaid period, <br />a pro rata protion of any prepaid subscriber service <br /> <br /> <br />
