233 <br /> <br />fee shall be refunded to the subscriber by the franchisee <br />using number of months as the basis. A full refund for less <br />than fifteen (15) days in a single month shall be the basis <br />for periods less than one (1) month. <br /> <br />7.5 <br /> <br />Advance Charges and Deposits: A franchisee may require <br />subscribers to pay the installation charge in advance and <br />to pay for each month of basic service in advance at the <br />beginning of each month. No other advance payment or <br />deposit of any kind shall be required by a franchisee for <br />basic subscriber service. Other than for a converter, <br />nothing in this provision shall be construed to prohibit <br />charges for or waiver for charges for initial installation <br />or reconnection. <br /> <br />7.6 <br /> <br />Installation and Reconnection: Except as otherwise pro- <br />vided elsewhere in this ordinance, a franchisee may make <br />a charge to subscribers for the installation of service <br />outlets and for the reconnection of service outlets, The <br />rates for such connection or reconnection shall be as <br />authorized in the rate schedule (Section 7.2). <br /> <br />7.7 <br /> <br />7.8 <br /> <br />Other Governmental Regulation of Rates: If in the future, <br />the State of North Carolina or the United States Government <br />or any regulatory agency thereof regulates the rates of <br />the franchisee for the service provided for in the franchise, <br />this section shall be of no effect during such regulation to <br />the extent of any conflict therewith. <br /> <br />Public Service Installation: The franchisee shall without <br />charge for installation, maintenance or service make single <br />installations of its standard CATV service facilities to <br />those public buildings operated by Cabarrus County when <br />the building is located on the franchisee's system when the <br />system is constructed consistent with the requirements of <br />this ordinance. Such installations shall be made at such <br />reasonable locations as shall be requested by the County <br />Manager. Any charge for relocation of such installation <br />shall, however, be charged at actual cost~ Additional <br />installations at the same location may be made at normal <br />charge. No monthly service charges shall be made for <br />distribution of the franchisee's signals within such <br />publicly owned buildings. <br /> <br />In addition, the franchisee shall without charge for install- <br />ation, maintenance or service, make single installations <br />of its standard community service facilities at any other <br />County-owned facility identified in the franchise agreement. <br />Further, no installation to any of the above mentioned lo- <br />cations shall be made until requested in writing by the <br />County Manager. <br /> <br />7.9 Charges for Public Access: Charges to users of the fran- <br /> chisee's production facilities for public access programming <br /> shall not exceed actual costs incurred. Such charges shall <br /> be publicly posted and made available at no cost to anyone <br /> upon request. Charges shall be clearly and completely <br /> stated in the operating rules for public access programming. <br /> Such charges may be amended only upon approval by the <br /> Board of Commissioners. Franchisee shall furnish standard <br /> playback facilities and labor at actual cost incurred for the <br /> public access channel. <br /> <br />8. General Financial Provisions. <br /> 8.1 Expense Reimbursement to County: <br /> <br /> The franchisee shall <br />pay the County a sum of money which will, when added to <br />application fees received, reimburse all costs and expenses <br />incurred by it in connection with preparation of this ordinance, <br />the franchise agreements and the granting of a franchise, <br />including, but not limited to, consultant fees, attorneys' <br />fees, publication fees, travel expenses, and all other direct <br />costs; provided, however, that the County shall submit a <br />detailed schedule of all such costs.
