245 <br /> <br />(a) Advise the Board of Commissioners on applications <br /> for franchises, unless the Board of Commissioners <br /> shall otherwise provide for the handling of this function; <br /> <br />(b) Advise the Board of Commissioners on matters which <br /> might constitute grounds for revocation of the franchise <br /> in accordance with this ordinance; <br /> <br />(c) Resolve disagreements among franchisees, subscribers <br /> and public and private users of the system; such de- <br /> cisions of the County Manager shall be appealable to the <br /> Board of Commissioners; <br /> <br />(d) Advise the Board of Commissioners on the regulation of <br /> rates in accordance with this ordinance. The said <br /> advisory function shall be in the form of a written <br /> report to the Board of Commissioners, which shall <br /> include recommendations to the Board of Commissioners <br /> and the facts upon which the said recommendations are <br /> based; <br /> <br />(e) Coordinate franchisee and County activities for the best <br /> use of public facilities and channels of the system; <br /> <br />(f) Advise the Board of Commissioners regarding general <br /> policy relating to the services provided subscribers <br /> and the operation and use of public channels, with a <br /> view to maximizing the diversity of Rrograms and ser- <br /> vices to subscribers. The use of public channels shall <br /> be allocated on a first come, first served basis, sub- <br /> just to limitations on monopolization of system time <br /> or prime time; <br /> <br />(g) Require an audit of all franchisee records required by <br /> this ordidance and, in his discretion, require the pre- <br /> paration and filing of information additional to that <br /> required herein. <br /> <br />(h) Make an annual report to the Board of Commissioners, <br /> including: an account of franchise fees received and <br /> distributed, the total number of hours of utilization of <br /> public channels, and hourly subtotals for various <br /> programming categories, and a review of any plans <br /> submitted during the year by franchisee(s) for develop- <br /> ment of new services. <br /> <br />(i) Conduct evaluations of the system at least every five <br /> (5) years with the franchisee, and pursuant thereto, <br /> make recommendations to the Board of Commissioners <br /> for amendments to this ordinance or the franchise agre- <br /> ement. <br /> <br />18. Franchise Application. <br /> 18.1. Requests for Proposals: <br /> <br /> The Board of Commissioners <br />may, by advertisement or any other means, solicit and call <br />for applications for CATV system franchises, and may <br />determine and fix any date upon or after which the same <br />shall be received by the County, or the date before which <br />the same must be received, or the date after which the <br />same shall not be received, and may make any other deter- <br />minations and specify any other times, terms, conditions <br />or limitations respecting the soliciting, calling for, making <br />and receoving of such applications <br /> <br />19.
