247 <br /> <br />1. This ordinance is adopted under the authority of <br />Chapter 153A, Article 18, Part 2 of the General Statutes <br />of 'North Carolina. <br />Section D. Jurisdiction <br />1. These regulations shall govern each and every sub- <br />division of residential land lying within Cabarrus <br />County and outside the subdivision regulation jur- <br />isdiction of any municipality; unless such municipal- <br />ity ~. shall have resolution <br />formally requested the County to enforce these re- <br />gulations within the City's area of jurisdiction. <br />Section E. General Requirements <br />1. Conformity: Ail proposed subdivisions shall be <br />planned so as to facilitate the most advantageous <br />development of the entire neighboring area. <br />2. Extension of Existing Streets: The proposed <br />street system shall extend existing streets on their <br />proper projection at the same width, or, at the <br />option of the subdivider, greater width, than the <br />minimum required by N.C. - D.O.T., Subdivision Roads <br />Standards. <br />3. Access to Adjacent Property: Provisions for <br />access to adjacent undeveloped property may be a <br />part of the subdivision. <br />4. Public or Private Streets: Public streets are <br />preferred in all subdivisions. Where a subdivider <br />elects to establish private streets, minimum con- <br />struction standards shall be the same as required <br />for public streets. *'Subdivision Streets Disclosure <br />Statement" as required by General Statute, 136-102.6 <br />shall be a part of this ordinance. <br />5. Relation to.Topography: In sloping terrain, <br />streets should follow the contours of the land, in <br />so far as practicable, to avoid steep grades and <br />the concentration of storm water ru~pff. <br />6. Relating to Railroad Right-of-way: When a sub- <br />division adjoins a railroad right-of-way, the sub- <br />divider .may be required to arrange the street pat- <br />tern to provide for the future grade separation of <br />streets and railroad crossing. <br />7. Half of Right-of-way: The dedication of only <br />half the necessary right-of-way for a street or road <br />at the perimeter of a proposed subdivision is pro- <br />hibited. Where such a street half is existing in <br />a present subdivision, the remaining half shall be <br />provided by an adjacent proposed subdivision. <br />8. Access Streets: Where a tract of land to be <br />subdivided adjoins an interestat~ighway, the sub- <br />divider may be required to provide a marginal access <br />street parallel to the interstate highway right-of-way. <br />9. Street Names: Proposed street names shall not <br /> be duplicate or deceptively similar to the name of <br /> any other street within Cabarrus County. Where pro- <br /> posed streets are extensions of existing streets, the <br /> existing names shall be used. <br /> 10. Easements: Easements not less than ten (10) feet <br /> wide shall be provided for open or piped storm drain- <br /> age, sanitary sewers, waterlines and other utilities. <br /> Easements may be incorporated in the street right-of-way, <br /> if approved by the N. C. Department of Transportation. <br /> 11. Proposed Sewerage Systems: Sewer systems shall <br /> be regulated by the State and County Health Departments. <br /> 12. Flood Plain Regulations: Areas lying within de- <br /> signated flood plains shall be subject to the follow- <br /> ing regulations: <br /> (a) No building or structure shall be erected, <br /> and no existing building or structure shall <br /> be extended or moved unless the first floor <br /> of said building or structure is placed one <br /> foot above the elevation of the 100 year <br /> flood. No basement floor or other floor <br /> shall be constructed below or at a lower <br /> elevation than one foot above the elevation <br /> of the 100 year flood. <br /> <br /> <br />
