261 <br /> <br /> NOW, THEREFORE, BE IT ORDAINED by the Board of Commissioners of <br />Cabarrus County: <br /> Section 1. That Cabarrus County (hereinafter referred to as "the <br />County") hereby grants the non-exclusive right, privilege, and franchise to <br />Vision Cable Communications, Inc., (hereinafter referred to as "the <br />Company") to construct, operate and maintain a cable television system in <br />Cabarrus County for a period of fifteen (15) years from and after the date <br />of acceptance of this ordinance, and for such purpose to use any roads, alleys, <br />or other public property of County,. but subject always to present and future <br />ordinances pertaining thereto. Cabarrus County expressly reserves the right <br />to grant other rights, privileges, and franchises' to any other person or <br />entity at any time during the term hereof. <br /> Section 2. The right, privilege, and franchise hereby granted are <br />expressly subject to the following: <br /> (A) Ail provisions of an ordinance heretofore adopted by the <br /> Board of Commissioners of Cabarrus County on October 5, <br /> 1978, entitled "An Ordinance Providing For The <br /> Grant Of A Franchise For the Construction, Operation, <br /> Maintenance, and Regulation Of A Cable Television System <br /> (hereinafter referred to as "the CATV Ordinance"), all <br /> provisions of said ordinance being hereby specifically <br /> incorporated herein by reference; and , <br /> (B) All provisions of the Company's "Cable TV Franchise <br /> Application Prepared for Cabarrus County, North <br /> Carolina", dated September 7, 1978, (hereinafter <br /> referred to as "the proposal"), a copy of which is on <br /> file at the Office of the County Clerk, all provisions <br /> of which are hereby specifically incorporated herein <br /> by reference. <br /> RATES. The following is the subscriber rate schedule for cable <br /> television service. <br /> Residential Rates - Residential Installation Fees: <br /> First TV $15.00 <br /> Additional TV $10.00 <br /> ~ $1o.oo <br /> Relocate $10.00 <br /> Reconnect $10.00 <br /> Transfer $10.00 <br /> Pay TV (when installed after initial installation) $10.95 <br /> Residential Monthly Fees: <br /> Economy Service <br /> (Channels 2-13) <br /> First TV $ 7.00 <br /> Additional TV $ 1.50 <br /> FM $ 1.50 <br /> Full Dial Family Service <br /> (Channels B-K) <br /> First TV $ 2.00 <br /> Additional TV $ 1.00 <br /> Home Box Office (Channel A) <br /> First TV $ 9.00 <br /> Additional TV -0- <br /> Home Theater (Channel L) <br /> First TV $ 4.00 <br /> Additional TV -0- <br /> Section 3. The Company, by accepting the rights hereby granted, <br /> covenants that it will perform and keep all acts, covenants and obligations <br /> imposed, represented or promised by the provisions of this ordinance, the <br /> CATV Ordinance and the Proposal, including the completion of the construc- <br /> tion of its plant and the activation of its system in accordance with, to the <br /> extent of, and within the periods of time shown on its construction schedule in <br /> its proposal, and any failure to do so will be grounds for termination of the <br /> rights hereby granted in accordance with the provisions of the CATV Ordinance. <br /> Section 4. The effective date .of this Ordinance shall be the date of <br /> its final adoption, and said date shall be utilized for the commencement of the <br /> timetable for construction contained in the Proposal and for all other purposes. <br /> Section 5. In addition to the conditions contained above and in the <br /> CATV Ordinance and in the Proposal, the rights hereby granted may, at the <br /> · option of Cabarrus County, be terminated upon the happening of any of the <br /> following: <br /> <br /> <br />
