It shall, at its own expense, provide suitable and adequate <br /> repair and maintenance for each of the motor vehicles leased <br /> hereunder and shall perform all preventive maintenance as may <br /> be specified by the Board. <br /> 6. Termination. <br /> a. This agreement shall continue until the end of the term <br /> or upon breach of the agreement by the County. <br /> b. Upon termination of this agreement, the County shall re- <br /> turn to the Board all items of equipment leased hereunder in <br /> the same condition as when acquired, ordinary wear and tear <br /> expected. <br /> 7. Benefits. Cook <br /> Chairman, Board of Commissioners <br /> UPON MOTION of Commissioner Lentz, seconded by Commissioner Milloway and <br />unanimously carried, the Board approved a request from K & K International, Inc., <br />to discharge fire works on May 27, 1979, or the subsequent clear night as a "rain <br />date" night within the confines of the Charlotte Motor Speedway. <br /> UPON MOTION of Commissioner Allen, seconded by Commissioner Lentz and unani- <br />mously carried, the Board adopted the following Personnel Ordinance Amendment: <br />"If a holiday as designated by the County Personnel Ordinance falls on a day <br />other than Monday and is designated Nationally to be observed on a Monday, then <br />the County policy is amended to observe that holiday on a Monday." <br /> Mr. McGinnis reported to the Board that the National Association of Counties <br />would hold their annual conference in Kansas City, Missouri, from July 15-18, 1979. <br />Chairman Cook, Commissioners Lentz, Milloway, and Bonds and Mr. McGinnis stated <br />that they would be in attendance. <br /> UPON MOTION of Commissioner Lentz, seconded by Commissioner Bonds and unani- <br />mously carried, the Board adopted the following resolution: <br /> Whereas, the Board of Commissioners has received the required petition, re- <br />commendations and approvals required by Section 69-25.11 (4) of the General Statutes <br />of North Carolina; and Whereas, the Board of Commissioners set May 14, 1979, at <br />10:00 A.M. as the date and time of the public hearing on the petition to transfer <br />the territory hereinafter described from Midland Fire Protection District to Flowe's <br />Store Fire Protection District; and notice was duly published as required and said <br />hearing was held at 10:00 A.M., on May 14, 1979, and no one appeared at said hearing; <br /> Now therefore, the following described territory is transferred from the <br />Midland Fire Protection District to the Flowe's Store Fire Protection District: <br /> BEGINNING at a point (1) on N. C. 27, 1000 feet east of its inter- <br /> section with Flowe's Store Road (1132); thence in a northeasterly <br /> direction to a point (2), 500 feet north of the intersection of the <br /> south branch of Anderson Creek with Sam Black Road (1127); thence <br /> northeasterly to a point (3) where the north branch of Anderson <br /> Creek intersects the Bethel Church Road (1125); thence northeasterly <br /> to a point (4) on Cal Bost Road (1143), 1.1 miles west of its in- <br /> tersection with Troutman Road (1145); thence along Cal Bost Road <br /> (1143) to a point (5) at the intersection of Cal Bost Road (1143) <br /> and U. S. 601 including property 500 feet north of and parallel to <br /> Cal Bost Road (1143); thence northerly along U. S. Highway 601 to <br /> a point (6), 500 feet south of its intersection with Joyner Road <br /> (1105) including property 500 feet west of U. S. 601; thence south- <br /> erly along U. S. 601 to a point (7), 0.3 mile south of its inter- <br /> section with Flowe's Store Road, East (1147) including property <br /> 1500 feet east of U. S. 601 between this and the preceding point; <br /> thence in a southerly direction along U. S. 601 to a point (8) at <br /> its intersection with Cal Bost Road (1143); thence westerly along <br /> Cal Bost Road (1143) to a point (9), 1000 feet east of its inter- <br /> section with Troutman Road (1145); thence 100 feet east of and <br /> parallel to Troutman Road to a point (10) on Anderson Creek at <br /> its intersection with Troutman Road; thence southwesterly along <br /> Anderson Creek to a point i(11) where Sam Black Road (1127) crosses <br /> Anderson Creek; thence southwesterly to the point of BEGINNING. <br /> <br /> <br />
