336 <br /> <br />Section I. Jurisdiction <br /> <br /> On and after August 13, 1979, these regulations shall apply to all residential <br />type development within Cabarrus County, North Carolina, and outside the jurisdic- <br />tion of any municipality. <br /> <br />Section II. Definitions <br /> <br />For the purposes of this ordinance, the following shall apply: <br /> <br /> 1. Residential Unit - dwelling: Any building used exclusively for human <br />habitation. <br /> <br /> A. Single-family dwelling: A detached building used exclusively as <br />a place of residence for one family. <br /> <br /> B. Dual-family dwelling: A building used as a place of residence for <br />two (2) families occupying separate dwelling units. <br /> <br /> 2. Multi-residential Unit - A grouping of 3 or more residential units that <br />are contiguous by their construction either horizontally or vertically. <br /> <br /> A. Multi-family dwelling unit (apartment): A combination of three (3) <br />or more residential units under the same ownership for the purpose of rent- <br />ing or leasing. <br /> <br /> B. Condominium: Single unit residential ownership in a multi-unit <br />structure with common open space. <br /> <br /> C. Multi-family - Individual ownership (Townhouses, Rowhouse, Patio <br />Home, etc.): Single residential ownership in a multi-unit structure with <br />the lot lines defined. <br /> <br /> 3. Lot - A parcel or tract of land described by metes and bounds in a legal <br />instrument recorded or filed in the Cabarrus County Courthouse, or shown on a <br />plat recorded in the Cabarrus County Registry. <br /> <br /> 4. Space - An area within a lot clearly defined by corners, fences or other <br />visual marking and leased or rented by the owner of the lot. <br /> <br /> 5. Residential Type Development - Any lot or space on which there is located <br />any residential unit or multi-residential unit. <br /> <br /> 6. Water - Potable water furnished to lots or spaces from a municipal, sani- <br />tary, or community system approved by the Health Department. <br /> <br /> 7. Planned Residential Development - An area of at least three (3) acres <br />allowing a mixture of residential types, planned and developed as a unit, in a <br />single development operation or a programmed series of development operations and <br />in accordance with a plan for which a special use permit has been approved by the <br />Cabarrus County Planning Board. <br /> <br /> 8. Sewer - Means of collecting and disposing of domestic sewerage from lots or <br />spaces by a municipal, sanitary, or community system approved by the Health <br />Department. <br /> <br />9. Well Water - Underground potable water derived on a lot or space. <br /> <br />10. Septic Tank - A means of disposing of domestic sewage on a lot or space. <br /> <br /> 11. Building Setback Line - The minimum allowable distance between a building <br />and a street or property line street. <br /> <br /> 12. Street - A right-of-way, public or private, which provides ingress and <br />egress for a lot or space. <br /> <br />Section III. In General <br /> <br /> No person, firm or corporation shall begin to use a lot or space as or for <br />the purpose of a residential type development as hereinbefore defined or begin the <br />construction, reconstruction, alteration, repair, erection or location on said lot <br />or space of a unit or structure to be used for living or sleeping purposes until <br />he or it shall apply for and receive a permit from the Cabarrus County Building <br />Inspector or other officer, employee, or agent of Cabarrus County appointed by the <br />Board of County Commissioners of Cabarrus County. In cases other than single <br />family detached or dual-family residential units, the developer must file an <br /> <br /> <br />
