386 <br /> <br /> The substitute motion made by Chairman Cook and seconded by Commissioner <br />Bonds that the Board refer the matter regarding the music festival planned for <br />the Charlotte Motor Speedway and the petitions to the District Attorney was <br />defeated with Chairman Cook and Commissioner Bonds voting for and Commissioners <br />Milloway, Lentz, and Allen voting against. <br /> UPON MOTION of Commissioner Lentz, seconded by Commissioner Bonds and <br />unanimously carried, the Board moved to go into Executive Session to discuss <br />the acquisition of land. <br /> UPON MOTION of Commissioner Lentz, seconded by Commissioner Bonds and <br />unanimously carried, the Board moved to terminate the Executive Session. <br /> Chairman Cook stated that no decision had been made regarding the purchase <br />of land and the Board had authorized the County Manager to continue negotiations <br />for this land. <br /> Mr. John Boger, County Attorney, reported that a hearing had been held on <br />the County's motion to dismiss the lawsuit against the four County officials <br />for salary compensation by the Kannapolis patrolman, Steve May. He stated <br />the complaint had been amended at that time by the plaintiff's attorney to <br />bring suit against Cabarrus County on the same allegations. The County is to <br />file a response to this complaint within thirty (30) days. <br /> Mr. John Boger reported that he had discussed the charges made by the <br />State regarding alleged unallowable expenditures made by the Community Relations <br />Commission during 1974 and 1975 with the City Manager and City Attorney. <br />Mr. Boger recommended that the Board deny any responsibility to these charges <br />at this time. The Board authorized Mr. Boger to handle this matter. <br /> UPON MOTION of Commissioner Lentz, seconded by Commissioner Milloway and <br />unanimously carried, the Board moved to adjourn. <br /> <br />Clerk to the Board <br /> <br /> <br />
