Ail information provided by the DEPARTMENT to the LAW ENFORCEMENT <br /> AGENCY(IES) and all information obtained by the LAW ENFORCEMENT <br /> AGENCY(IES) in performing child support enforcement services under this <br /> AGREEMENT shall be used only in the furtherance of the purposes of tis <br /> AGREEMENT and for no other purpose. Nothing in this AGREEMENT §hall <br /> be construed to permit the use of any information in violation of any <br /> North Carolina or Federal law. <br /> The DEPARTMENT agrees to the following: <br /> A. In accordance with the State Plan filed by the DEPARTMENT with the <br /> Department of Health, Education, and Welfare pursuant to Title IV-D <br /> of the Social Security Act, that the staff of the Child Support <br /> Enforcement Section of the Division of Social Services of the <br /> DEPARTMENT shall be liaison among the COUNTY COMMISSIONERS, the <br /> DESIGNEE, and the DEPARTMENT; <br /> B. That the Child Support Enforcement Section shall lend technical <br /> assistance and advice to the COUNTY COMMISSIONERS and the DESIGNEE; <br /> C. To reimburse the COUNTY COMMISSIONERS or the DESIGNEE at the rate <br /> of seventy-five (75) per centum of approved expenses submitted to the <br /> DEPARTMENT by the DESIGNEE under this AGREEMENT as set out in 42 USC 655. <br /> Approved expenses shall only include those reimbursable under Federal <br /> law; <br /> D. In .accordance with 42 U.S.C. 658, as amended, to make incentive <br /> payments to the COUNTY COMMISSIONERS for the enforcement and collection <br /> of the support rights in an amount equal to fifteen (15) per centum <br /> of any amount collected and required to be distributed as provided <br /> in 42 U.S.C. 657, as amended, for purposes of offsetting administrative <br /> costs of operating the program in the county served by the COUNTY <br /> COMMISSIONERS or any other county of the State of North Carolina; and <br /> E. To return to the COUNTY COMMISSIONERS those incentives received as a <br /> result of collections being made on behalf of and transferred to <br /> another state. Ail amounts so collected shall be distributed in <br /> accordance with 42 U.S.C. 657 as amended. <br /> With respect to the DEPARTMENT and the COUNTY COMMISSIONERS this AGREEMENT <br /> shall be effective for an indefinite period of time unless terminated <br /> according to the terms of G.S. 110-141. <br /> With respect to the DEPARTMENT and any LAW ENFORCEMENT AGENCY, this <br /> AGREEMENT shall be effective for an indefinite period of time unless <br /> terminated according to the terms of G.S. 110'141. <br /> This AGREEMENT may be terminated by the DEPARTMENT by giving the parties <br /> 30 days written notice of the intent to terminate. <br /> This AGREEMENT may be modified upon the agreement in writing of all parties <br /> affected by the proposed modification provided, however, that this <br /> AGREEMENT shall be modified by operation of law upon the amendment or <br /> repeal of the governing state or Federal laws provided that any notification <br /> for modification given under Chapter 110 Article 9 shall be in writing. <br /> <br /> The DEPARTMENT, the COUNTY COMMISSIONERS, and the LAW ENFORCEMENT AGENCY(IES) <br />have caused this AGREEMENT to be executed by their duly authorized representative <br />as follows: <br /> <br />19 <br /> <br />Executed in , North Carolina, this the day of <br /> , for the North Carolina Department of Human Resources, <br /> <br />By: <br /> <br />Sarah T.
