432 <br /> <br />snack bar located in the basement area of the Cabarrus County Courthouse. <br />The County will provide only the space and the electrical and water utilities <br />for this~concession stand. The operation of the snack bar is on an annual <br />basis effective July 1 of each year and will be reviewed annually by the <br />Board to determine if its use should be authorized for another year. If <br />the operation of the snack bar is unsatisfactory at any time, the Board has <br />the option to terminate its operation at the Board's discretion with <br />sixty (60) days notice to Mr. Nolan. Mr. Nolan will give the Board sixty <br />(60) days notice if he desires to discontinue operation of the concession <br />stand. <br /> UPON MOTION of Commissioner Milloway, seconded by Commissioner Lentz <br />and unanimously carried, the Board authorized Chairman Cook to sign the <br />following agreement between the Board of Commissioners, Law Enforcement <br />Agencies, and the Department of Human Resources~.~ <br /> <br /> This is an AGREEMENT between the Board of Commissioners of Cabarrus <br />County (hereinafter referred to as the COUNTY COMMISSIONERS); and <br /> <br />) <br />) <br />) COOP ERAT IVE <br />) AGREEMENT <br />) <br /> <br />(hereinafter referred to collectively as the LAW ENFORCEMENT AGENCY(IES)); <br />and the North Carolina Department of Human Resources (hereinafter referred <br />to as the DEPARTMENT). <br /> <br /> The purpose of this AGREEMENT is to implement the child support enforce- <br />ment provisions of Title IV-D of the Social Security Act as amended (sub- <br />stantially codified as 42 U.S.C. 651-662), corresponding Federal regulations, <br />and Chapter 110, Article 9 of the General Statutes of North Carolina (herein- <br />after referred tO as the CHILD SUPPORT ENFORCEMENT PROGRAM). To effect <br />this purpose, the above-mentioned parties, in consideration of the mutual <br />covenants and promises hereinafter contained, hereby agree to the following <br />duties. <br /> I. The COUNTY COMMISSIONERS agree to: <br /> A. Assist the DEPARTMENT in providing the services necessary to <br /> establish paternity and secure support for children receiving <br /> Aid to Families with Dependent Children (hereinafter referred <br /> to as AFDC) benefits under Title IV-A of the Social Security <br /> Act, or individuals not receiving AFDC, consistent with the <br /> provisions of 42 U.S.C. 654(6) and the regulations promulgated <br /> pursuant thereto, and in accordance with the manual published <br /> and provided by the DEPARTMENT. In the case of services <br /> extended to non-recipients of AFDC benefits, a fee may be charged <br /> according to the criteria set by the DEPARTMENT; <br /> B. Designate a local agency within county government (hereinafter <br /> referred to as the DESIGNEE) to administer and monitor the <br /> local operations of the CHILD SUPPORT ENFORCEMENT PROGRAM and <br /> to notify the DEPARTMENT of such designation; and if such <br /> designation changes, to notify the DEPARTMENT of such change. <br /> Employ the services of an attorney for all matters for which <br /> an attorney is required and to notify the DEPARTMENT of such <br /> employment, further if such employment is terminated, to notify <br /> the DEPARTMENT of the attorney subsequently employed. <br /> C. Mmintain such records as are deemed necessary by the DEPARTMENT <br /> to assure a proper accounting for all costs. These records shall <br /> be made available to the DEPARTMENT, the State Auditor, any other <br /> authorized representative of the State of North Carolina for <br /> audit, or authorized representative of the Federal Government <br /> Agency administering the PROGRAM on the federal level and should <br /> be retained for a period of three years with the following <br /> qualifications: if audit by or on behalf of the Federal Government <br /> has begun but is not completed at the end of the three year period, <br /> or if audit findings have not been resolved at the end of the three <br /> year period,' the records shall be retained until resolution of the <br /> audit findings; <br /> D. Make financial, program progress, and other reports as requested <br /> by the DEPARTMENT; <br /> <br /> <br />
