433 <br /> <br />Require the DESIGNEE to perform the following functions. <br />(1) To refer all absent parents cases needing legal advisement <br /> to the appropriate courts or law enforcement officials <br /> immediately whenever: <br /> (a) The absent parent refuses to be interviewed, to provide <br /> necessary information, or to discuss his parental <br /> responsibilities; <br /> (b) The absent parent refuses to make a contribution in <br /> accordance with his financial ability; <br /> (c) There is reason to believe that the absent parent may <br /> flee or hide if contacted by the DESIGNEE; <br /> (d) The absent parent's previous history indicates that, <br /> although he is capable of a support contribution, <br /> efforts by the DESIGNEE to obtain support would be <br /> fruitless; <br /> (e) Legal action is necessary to establish paternity; <br /> (f) The'absent parent has entered into an agreement with the <br /> DESIGNEE for support of his child and has defaulted upon <br /> that agreement without showing good cause for such default; <br /> (g) Assistance is needed from a law enforcement agency to <br /> locate the absent parent; <br /> (2) To provide law enforcement officials with pertinent information <br /> needed in iocating putative or absent parents, establishing <br /> paternity or securing Support from these same absent parents; <br /> (3) To assist courts and law enforcement officials in carrying <br /> out efforts to establish paternity and secure support for <br /> children born out of wedlock, and to secure support for <br /> children deserted or abandoned by their parents; <br /> (4) To use reciprocal arrangements with other states to obtain <br /> or enforce court orders for support, and to cooperate with <br /> LAW ENFORCEMENT AGENCY(IES) with regard to reciprocal actions. <br /> (5) To cooperate with the Child Support Enforcement agencies in <br /> other states in locating the absent parents of children for <br /> whom support is being sought, and in attempting to secure <br /> parental compliance with court orders for support when such <br /> parents are residing.in the DESIGNEE'S own county; <br /> (6) To assist other states with: <br /> (a) Locating absent parents, establishing~paternity, or <br /> securing support for children believed to be located in the <br /> other states; <br /> (b) Enforcing of all court orders or obligations referred by <br /> another state pursuant to the Uniform Reciprocal Enforce- <br /> ment of Support Act; <br /> (c) Collecting any support payments from the absent parent <br /> and transmitting them to the state or person(s) in the <br /> state to which they are owed; <br /> (d) Providing sufficient information for action on child <br /> support related cases; <br /> (7) To refer to the DEPARTMENT cases which require locational <br /> activities in other states and to provide sufficient <br /> information to the DEPARTMENT which may assist the other <br /> state(s) in locating and identifying an absent parent; <br /> (8) To take action to establish, by legal process, paternity <br /> or a support obligation, where necessary, in accordance with <br /> Article 9 of Chapter 110; <br /> (9) To maintain a system for identifying those cases in which <br /> there has been failure to comply with support obligations <br /> and to notify the delinquent individual(s) in order to enforce <br /> the obligations for purposes of collecting the current support <br /> obligations ~and any arrears. Such attempts to collect support <br /> must include the institution of the following procedures as <br /> applicable, appropriate,.and necessary : <br /> (a) Contempt proceedings to enforce court order; <br /> (b) Garnishment of obligor's wages; <br /> (c) Attachment of real or personal property; <br /> (d) Application for collection of the delinquent child support <br /> obligation by the United States SeCretary of the Treasury <br /> by authority of 42 U.S.C. 652; <br /> <br /> <br />
