477 <br /> <br />Bo <br /> <br />Organization, Officers, Records <br /> The Commission shall annually elect its own officers <br />consisting of a Chairperson and Vice-Chairperson, and <br />select persons to perform the duties of Secretary and <br />Treasurer. The Chair shall be rotated each year among <br />members appointed by each of the Participating Units. The <br />Chair shall vote only in cases of ties. The Commission <br />shall adopt rules and by-laws that will become effective <br />when approved by the governing board of each Participating <br />Unit. The Commission shall choose either its Park Director as Secretary, <br />or the Director of either the Cabarrus or Rowan Park and <br />Recreation Commission shall serve ex officio as Secretary. <br />The Commission shall also select the finance officer of <br />one of Participating Units to serve as Treasurer. The <br />Commission shall hold regular bi-monthly meetings in <br />accordance with the~Open Meetings Law. The Secretary shall <br />keep full and accurate minutes of its meetings which shall <br />constitute public records. The Commission shall at all <br />times comply with provisions of law regarding open meetings, <br />public records and privacy of personnel records. <br />Powers and Duties <br /> (i) The Commission shall provide, maintain, manage, operate <br /> and supervise the parks and recreation facilities possessed <br /> and/or controlled by the Commission pursuant to leases, <br /> joint use agreements or otherwise. <br /> (ii) The Commission may provide, promote, administer and <br /> conduct recreation and cultural programs and services in <br /> or at parks and recreation facilities possessed and/or <br /> controlled by it under this Agreement. The Commission shall <br /> direct and administer those recreation and cultural programs <br /> and services provided at its parks and recreation facilities. <br /> (iii) The Commission shall employ a Park Director and may <br /> employ such other personnel as are necessary or desirable in <br /> fulfilling the Commission's responsibilities, within the <br /> limits of funds available to the Commission or appropriated <br /> to it by the Participating Units. <br /> (iv) The Commission may enter into interlocal cooperation, <br /> joint use or management agreements with Participating Units <br /> to the full extent permitted by law. <br /> (v) The Commission may purchase liability insurance covering <br /> such risks and in such amounts as the Commission may deem <br /> appropriate. <br /> (v~) The Commission may adopt uniform schedules of reasonable <br /> fees or charges for use of facilities controlled by it or for <br /> programs or services provided by it. Such schedules may <br /> impose like or different fees or charges for residents as <br /> opposed to non-residents of Participating Units. <br /> (vii) The Commission may solicit, apply for and accept grants, <br /> gifts, donations, contributions and bequests in support of <br /> its operations or responsibilities. Any such grant, gift, <br /> donation, contribution or bequest shall be held and used <br /> subject to the terms or conditions under which the same is made <br /> and accepted. The Commission may not accept any gift, grant, <br /> donation, or contribution of real estate without the unanimous <br /> consent of Participating Units and only as agent for said <br /> Participating Units as tenants in common. <br /> (viii) The Commission shall have power to contract and be <br /> contracted with; to sue and be sued; to acquire, purchase and <br /> hold any personal property; to acquire any interests in real <br /> estate only as provided in this Agreement; and to dispose of <br /> personal property in the manner provided for by law or disposal <br /> of county or city property. <br /> (ix) The Commission may issue orders and adopt regulations <br /> concerning the use of property under its control or the conduct <br /> of programs, services or activities on property under its control. <br /> (x) The Commission shall have no authority to enter into any <br /> contract or incur any obligation binding on any Participating <br /> Unit. <br /> <br /> <br />
