476 <br /> <br /> Mrs. Betsy Carpenter, President of the Cabarrus Animal Protection <br />Association, expressed disapproval of the proposed amendment to the dog <br />leash law and requested that the Board refer the matter back to the Health <br />Board for further action to formulate a separate Dog Lot Ordinance. <br /> Mr. Wayne Shue, resident of Crestmont Drive, requested that the Board <br />not consider any type of Dog Lot Ordinance. <br /> Mr. Manuel Kiser, Health Board member,~addressed the Board in regard <br />to a Dog Lot Ordinance, stating there was no need to send the matter back <br />to the Health Board as the Health Department presently has the authority <br />to investigate situations that are hazardous to the health of humans. <br /> UPON MOTION of Commissioner Cook, seconded by Commissioner Nash with <br />Commissioners Cook, Nash, and Payne and Chairman Bonds voting for and <br />Commissioner Lentz voting against, the Board moved to refer the matter of <br />a Dog Lot Ordinance back to the Cabarrus County Board of Health for further <br />consideration to determine if there are laws already in existence under <br />which the Health Department has the authority to correct situations in <br />which a dog lot is determined to be a health hazard. <br /> Mr. Tom Dayvault, a member of the Cabarrus County Parks and Recreation <br />Advisory Commission, reviewed the proposed Cabarrus-Rowan Parr Commission <br />Agreement with the Board. <br /> UPON MOTION of Commissioner Nash, seconded by Commissioner Payne and <br />unanimously carried, the Board adopted the following agreement establishing <br />the Cabarrus-Rowan Park Commission. <br /> <br />AN AGREEMENT BETWEEN LOCAL UNITS OF GOVERNMENT CREATING A JOINT PARK <br />COMMISSION TO BE KNOWN AS THE CABARRUS-ROWAN PARK COMMISSION. <br /> <br />WITNESSETH <br /> <br /> WHEREAS, Cabarrus and Rowan Counties (referred to herein, together <br />with any other local government that may become a party to this Agreement <br />as the "Participating Units") wish to cooperate to provide jointly park <br />services and facilities for the welfare of their citizens, and to provide <br />jointly recreation programs at such parks, and, <br /> WHEREAS, pursuant to G.S. 153A-444, G.S. 153A-445, Article 18 of <br />Chapter 160A and Article 20, Part 1 of Chapter 160A, cities and counties <br />may enter into undertakings to establish joint agencies to provide their <br />citizens park and recreation services and programs, and <br /> WHEREAS, the Participating Units wish to establish a joint agency <br />to be known as the "Cabarrus-Rowan Park Commission," as provided further <br />in this agreement, <br />NOW, THEREFORE, the Participating Units agree as follows: <br /> 1. Cabarrus-Rowan Park Commission Created <br /> The joint "Cabarrus-Rowan Park Commission" (hereinafter <br /> called the Commission) is established. <br /> 2. Composition, Organization, Nature, Powers and Duties <br /> A. Commission Membership and Compensation <br /> (i) The Commissioners size shall vary according to the <br /> number of Participating Units. Cabarrus and Rowan <br /> counties will appoint four members each and other <br /> Participating Units shall appoint such number of members <br /> as shall be mutually agreed upon at the time may become <br /> parties to this Agreement. The Commission's initial <br /> members shall be appointed within 90 days from the <br /> effective date of this agreement. Each Participating <br /> Unit shall stagger the terms of its initial appointees <br /> so that the term of one member shall expire in each <br /> of the first four years. Thereafter, each Participating <br /> Unit shall appoint members for four-year terms. No <br /> member shall serve more than two consecutive full <br /> terms. Vacancies on the Commission will be filled by <br /> the Participating Unit which appointed the member whose <br /> absence created the vacancy. <br /> (ii) Members of the Commission shall serve without compensation, <br /> other than reimbursement of necessary expenses while <br /> engaged in the work of or for the Commission, which re- <br /> imbursement shall be subject to limitations fixed by the <br /> Commission and the availability of funds appropriated to <br /> the Commission. <br /> (iii)Members shall be subject to removal with or without <br /> cause at any time in the discretion of the governing <br /> board of the Participating Unit that made the initial <br /> appointment. <br /> <br /> <br />
