517 <br /> <br /> 6. Tenant shall pay all utility costs including heating and air- <br />conditioning costs. <br /> 7. Owner~ shall provide casualty insurance coverage for said <br />building as is now available through the State Department of Public <br />Instruction or other appropriate agency providing casualty insurance <br />coverage for school buildings and facilities and Tenant shall pay the <br />insurance premiums allocated to the policy covering said building. <br /> 8. In the event the building is totally destroyed by fire or other <br />casualty, then the lease shall terminate at the option of either the <br />Tenant or the Owner. <br /> In the event the building is partially damaged by fire or other <br />casualty, Tenant may repair the same, using the insurance benefits <br />payable to the Owner and such other funds as Tenant may desire to use. <br /> 9. Tenant shall provide such public liability insurance coverage <br />as it provides for any other public building owned or leased by Tenant <br />as a governmental subdivision of the State of North Carolina, it being <br />expressly understood that Tenant does not waive its governmental immunity <br />by this clause in this lease. <br /> 10. Tenant shall have the right to access to said building from all <br />streets surrounding said building over the other property owned by <br />Owner and Tenant shall have the right to use the parking area now in <br />existence north of the original Carver School building in common with <br />others using said parking area, except that the Tenant shall have four <br />parking spaces reserved for use by Tenant or its designees. <br /> 11. Tenant shall maintain the grounds between the two streets and <br /> access road hereinbefore referred to an East of the West end of the <br /> original Carver School Building. <br /> 12. Tenant shall not be entitled to the possession of said premise <br /> until June 10, 1981, and shall not commence any renovations to the said <br /> premises until June 10, 1981. <br /> IN TESTIMOk~ WHEREOF, the parties have executed this lease the day <br /> and year first above written. <br /> <br />KANNAPOLIS BOARD OF EDUCATION <br />by: <br /> <br />ATTEST: <br /> <br />OWNER <br /> <br />CABARRUS COUNTY <br />by: <br /> <br />Chairman, Board of Commissioners <br /> <br />ATTEST: <br /> <br />Clerk <br /> <br />TENANT <br /> <br /> Chairman Bonds reported that several nurses at the Cabarrus County <br />Health Department had requested to participate in the State Credit Union. <br />Only those County employees who are under the State merit system classification <br />are eligible to participate in the credit union at this time due to State <br />regulations. <br /> UPON MOTION of Commissioner Lentz, seconded by Commissioner Payne and <br />unanimously carried, the Board agreed for Cabarrus County to become a <br />participating member of the State Credit Union by authorizing payroll <br />deductions for competitive service employees effective July 1, 1981. <br /> Mr. Charles McGinnis reported that a local citizen had requested <br />permission to lease land at the County Landfill area that is not presently <br />being used for the disposal of garbage. <br /> UPON MOTION of Commissioner Lentz, seconded by Commissioner Cook <br />and unanimously carried, the Board refused the request to lease land <br /> at the County Landfill. <br /> UPON MOTION of Commissioner Cook, seconded by Commissioner Payne and <br /> unanimously carried, the Board agreed to pay the members of the Cabarrus <br /> County Planning Board for any extra meetings which they attend. <br /> Mr. John Boger, Jr., County Attorney, reported that the Study Committee <br /> appointed by Mayor Harold McEachern had recommended to the Rocky River <br /> Regional Wastewater Steering Committee that a Sewer Authority composed <br /> of three members be set up to operate the wastewater treatment plant and <br /> interceptor sewer. This Authority would include one representative each <br /> from the City of Concord, Cabarrus County, and Cannon Mills. <br /> <br /> <br />
