516 <br /> <br /> UPON MOTION of Commissioner Nash, seconded by Chairman Bonds and <br />unanimously carried, the Board moved to go into Executive Session to discuss <br />the audit review of the Tax Collector's Office and to talk with Mr. Ray <br />McKinney, Tax Collector. <br /> UPON MOTION of Commissioner Lentz, seconded by Commissioner NashJ and <br />unanimously carried, the Board moved to terminate the Executive Session. <br /> Chairman Bonds reported the Board had discussed a personnel matter, <br />reviewed the audit report with Mr. Gil Johnson of Sherrill and Smith, and <br />talked with Mr. Ray McKinney during the Executive Session. He stated that <br />no action was taken by the Board during the Executive Session. Chairman <br />Bonds announced that copies of the audit report were available for the press. <br /> Commissioner Payne reported that the study committee composed of himself, <br />Mrs. ~tsy Carpenter, Mr. Charles McGinnis, and Mr. Leon Overcash were in <br />agreement that the licensing of dogs was the best and easiest way to handle the <br />dog problem in the County. He advised the Board that the Committee recommended <br />a $5.00 license fee per dog, male or female, up to a maximum fee of $25.00 <br />for persons who breed dogs or operate kennels. According to Commissioner Payne, <br />the dog owner would register his dog through the tax office and receive a tag <br />with number to place on the dog's collar. Commissioner Payne reported that <br />the committee proposed a $20.00 fine for each dog picked up and not registered. <br /> UPON MOTION of Commissioner Payne, seconded by Commissioner Lentz and <br />with Commissioners Payne, Lentz, Nash, and Chairman Bonds voting for and <br />Commissioner Cook abstaining, the Board directed the County Attorney to draw up <br />an appropriate ordinance or amendments to the existing ordinance authorizing <br />the licensing of dogs to be administered through the tax office as a tax on <br />dogs. The proposed ordinance will be presented to the Board at the next <br />meeting. <br /> UPON MOTION of Commissioner Nash, seconded by Commissioner Lentz and <br />unanimously carried, the Board adopted the following revised Lease Agreement <br />between Cabarrus County and the Kannapolis Board of Education. <br /> <br />NORTH CAROLINA <br /> <br />CABARRUS COUNTY <br /> <br />LEASE <br /> <br /> THIS LEASE AGREEMENT, made and entered into this 1st day of April, 1981, <br />by and between KANNAPOLIS BOARD OF EDUCATION, hereinafter referred to as <br />"OWNER", and CABARRUS COUNTY, hereinafter referred to as "TENANT"; <br /> WITNESSETH :- <br /> That whereas, Owner hereby leases to Tenant and Tenant hereby accepts <br />as Tenant from the Owner, subject to the terms and conditions hereinafter <br />set forth, the following described real property: <br /> Lying and being in No. 4 Township, Cabarrus County, North <br /> Carolina, and being the building known as the Carver School <br /> Annex Building, said building lying on the North side of <br /> West "C" Street, the West side of Lowe Street, and the South <br /> side of the access road to the new Kannapolis Middle School, and <br /> on the East side of the old original Carver School Building, <br /> together with a one-foot tract of land surrounding said building. <br /> The terms and conditions of this lease are as follows: <br /> 1. The term of this lease shall be for twenty (20) years. AS rental <br />Tenant shall pay to Owner the sum of One Dollar ($1.00) per year. <br /> 2. Provided that if all obligations and conditions of this lease have <br />been kept, Tenant may renew the same for an additional term of twenty (20) <br />years. The initial term of this lease shall begin on the 1st day of April, <br />1981, and continue for a twenty-year period thereafter. <br /> 3. Tenant shall provide its own heating and air-conditioning systems <br />for said building and will be afforded the necessary land upon which to <br />locate said heating and air-conditioning units, which land shall be a part <br />of the lease. <br /> 4. Tenant shall provide a stairway or elevator, or both, from the <br />ground floor to the second floor if the Tenant uses the second floor and <br />if it is necessary to construct these facilities outside the walls of the <br />present building, the land necessary for said construction shall be a part <br />of this lease. <br /> 5. Tenant shall be responsible for the maintenance and repair of said <br />building and all electricity, plumbing, heating and air-conditioning equip- <br />ment necessary for the enjoyment thereof, and shall return the building in <br />the same condition as it now is, fair wear and tear excepted. <br /> <br /> <br />
