561 <br /> <br /> The Board of Commissioners for the CoUnty of Cabarrus met in special <br />session at the Central Cabarrus High School Auditorium on Thursday, July 9, <br />1981, at 7:00 p.m. for the second public hearing on the proposed Zoning <br />Ordinance. <br /> Present -- Chairman: Ralph C. Bonds <br /> Commissioners: Troy R. Cook <br /> James W. Lentz <br /> Kenneth F. Payne <br /> Absent: Commissioner Harold Nash <br /> Members of the Cabarrus County Planning Board present were as follows. <br /> Ms. Cynthia Bostick <br /> Mr. Billy Plummer <br /> Mr. Frank Rankin <br /> Mr. John Cline <br /> Mr. Raiford Troutmen <br /> Chairman Bonds called the meeting to order and stated the purpose of the <br />meeting was to receive input from the public regarding the proposed Zoning <br />Ordinance. <br /> Mr. Robert Herndon acted as moderator for the remainder of the meeting. <br /> Mr. Franklin Ptummer, attorney, objected to mobile home restrictions and <br /> asked that citizens of the County have the opportunity to vote on the zoning <br /> issue. <br /> Mr. Greg Hamilton supported zoning regulations to insure orderly planned <br /> growth of the County in the future. <br /> Mr. R. M. Faggart, builder of modular homes, requested that the zoning <br /> regulations pertaining to manufactured housing be revised to differentiate <br /> between modular homes and mobile homes. He stated that modular homes complied <br /> with the same state building .regulations as a site-built home and should be <br /> given the same consideration in the ordinance. <br /> Mr. John C. Kee of Harrisburg stated the need for some type of zoning in <br /> the County in the future but denounced the proposed ordinance as being too <br /> restrictive and confusing. He objected to the restrictions on the number of <br /> chickens and animals per acre, the lot length to lot width ratio, and the <br /> classification of Township I as an Agricultural Rural/Residential District. <br /> Mr. Narry Beaver asked that the Board allow the people of the County to <br /> vote on zoning. <br /> Mr. Charles Henderson, attorney representing Mr. Manuel Kiser, stated the <br /> proposed ordinance contained a number of phrases and statements which could be <br /> challenged in court. He contended chat the County's public notice procedure <br /> for advertising the hearing was illegal as zoning maps were not published with <br /> the notice. <br /> Mr. Ray Calloway opposed zoning and costs associated with zoning <br /> administration. He expressed objection to the restrictions on mobile homes, <br /> the limitation of the type of vehicles allowed to park at one's home in a <br /> residential district, and the restriction Of the sale of property in a non- <br /> conforming use district. <br /> Mr. Jack Alston, former County Planner, of Skyway Drive in Concord <br /> challenged the legality of the public hearing for the proposed Zoning Ordinance, <br /> stating the ordinance had not received official certification by the Cabarrus <br /> County Planning Board as required by state law. <br /> Mr. James ~rray favored zoning regulations which would restrict the location <br /> of future junkyards and require screening of all junkyards from the public. <br /> Mr. Clarence Smith supported the screening of junkyards and asked that <br /> the zoning issue be brought to a vote by the people. <br /> Mr. Larry Williams, President of the Cabarrus County Homebuilders <br /> Association, objected to the lot length to lot width ratio as he stated this <br /> restriction would make some of the land in the County unusable. He requested <br /> that the Board appoint a Board of Adjustment if the ordinance is enacted. <br /> Mr. Allan Miles, representative of the Cabarrus County Board of <br /> Realtors, stated the Board of Realtors supported zoning but were opposed to <br /> the restrictions of the proposed ordinance and the twenty-five (25) different <br /> districts proposed for the County. Speaking as an individual, Mr. Miles <br /> disapproved of the proposed ordinance and requested that a simpler ordinance <br /> be drawn up by the Planning Department with the aid of a special advisory <br /> committee. <br /> Mr. Wood Furr opposed the concept of zoning. <br /> Mr. Wade Curry of Rimertown disfavored any type of zoning, contending <br /> it would deprive an individual of the freedom of his own property. <br /> Mr. Pink Motley objected to any zoning restrictions and to the cost of <br /> administering zoning regulations. <br /> <br /> <br />
