That the Clerk of the Board of Commissioners for the County <br />of Cabarrus is hereby directed to certify a copy of this resolution to the <br />Director, Division for Health Services, Department of Human Resources, <br />State of North Carolina. <br /> Thereupon, upon motion of Commissioner Nash, seconded by Commissioner <br />Cook, the foregoing resolution entitled: "RESOLUTION RELATING TO THE <br />ANNEXATION OF TERRITORY TO KANNAPOLIS SANITARY DISTRICT" was passed by <br />the following vote: <br /> Ayes: Chairman Bonds and Commissioners Nash, Cook, Lentz, and Payne <br /> Noes: None <br /> <br /> Mr. B. S. Brown, Jr., representing the Royal Oaks Sanitary District, <br />presented the following resolution which was read: <br /> <br />RESOLUTION RELATING TO THE ANNEXATION OF <br />TERRITORY TO ROYAL OAKS SANITARY DISTRICT <br /> <br /> BE IT RESOLVED BY THE BOARD OF COMMISSIONERS FOR THE COUNTY OF <br />CABARRUS: <br /> Section 1. That the Board of Commissioners for the County of <br />Cabarrus has determined and does hereby find and declare: <br /> (a) That on July 20, 1981 a resolution was received from the <br />Sanitary District Board of the Royal Oaks Sanitary District relating to <br />the annexation of territory to the Royal Oaks Sanitary District. <br /> (b) That the territory described in the petition consists of the <br />property of Hallmark Homes, Inc. <br /> (c) That the petition was signed by all property owners within the <br />area requested to be annexed. <br /> (d) That said petition requests that all necessary action required <br />by Article 12 of Chapter 130 of the General Statutes of North Carolina for <br />the extension of the boundaries of the Royal Oaks Sanitary District be <br />taken so as to annex the territory described in the petition unto the <br />Royal Oaks Sanitary District. <br /> (e) That it is for the best interest of the Royal Oaks Sanitary <br />District and the territory requested to be annexed unto the Royal Oaks <br />Sanitary District that said territory be included within the boundaries <br />of the Royal Oaks Sanitary District and receive the services of the <br />Sanitary District. <br /> Section 2. That the Board of Commissioners for the County of Cabarrus <br /> does hereby approve, the annexation of the territory described in the <br /> petition unto the Royal Oaks Sanitary District and does hereby recommend <br /> to the North Carolina Commission for Health Services that it approve the <br /> annexation of the territory unto the Royal Oaks Sanitary District. <br /> Section 3. That the Clerk of the Board of Commissioners for the County <br /> of Cabarrus is hereby directed to certify a copy of this resolution to the <br /> Director, Division for Health Services, Department of Human Resources, <br /> State of North Carolina. <br /> Thereupon, upon motion of Commissioner Nash, seconded by Commissioner <br /> Cook, the foregoing resolution entitled: "RESOLUTION RELATING TO THE <br /> Ab~EXATION OF TERRITORY TO ROYAL OAKS SANITARY DISTRICT" was passed by <br /> the following vote: <br /> Ayes: Chairman Bonds and Commissioners Nash, Cook, Lentz, and Payne <br /> Noes: None <br /> <br /> Mrs. Betsy Carpenter, President of the Cabarrus Animal Protection <br />Association, and a number of residents of Fairview Street in Kannapolis, <br />complained about the nuisance of and damages caused by the dogs kept <br />by Mrs. Ethel Honeycutt on Fairview Street in Kannapolis. Mrs. Carpenter <br />presented a listing of grievances against the dogs, citing numerous <br />incidents of persons being chased and bitten by the dogs. She requested <br />that the County take civil action against Ms. Honeycutt in order to remove <br />the dogs from the area. <br /> Mr. Leon Overcash, Dog Warden, reported that personnel of his <br />department had tried on numerous occasions to capture the dogs and <br />were unsuccessful. <br /> UPON MOTION of Chairman Bonds, seconded by Commissioner Nash and <br />unanimously carried, the Board directed Mr. John R. Boger, County <br />Attorney, to draw up an ordinance declaring the dogs of Mrs. Ethel <br />Honeycutt. a nuisance for presentation to the Board at its next regular <br />meeting with action to proceed as speedily as possible in this matter. <br /> <br /> <br />
