574 <br /> <br /> The Board of Commissioners for the County of Cabarrus met in called <br />session at 7:00 p.m. on Thursday, July 30, 1981, at the County Courthouse <br />in Concord, North Carolina, for the purpose of reviewing the proposed <br />Zoning Ordinance. <br /> Present - Chairman: Ralph C. Bonds <br /> Commissioners: J. Harold Nash <br /> Troy R. Cook <br /> James W. Lentz' <br /> Kenneth F. Payne <br /> Members of the Cabarrus County Planning Board present for the meeting <br />were as follows: <br /> Ms. Cynthia Bostick <br /> Mr. Frank Rankin <br /> Mr. John Cline <br /> Chairman Bonds called the meeting to order and stated that this meeting <br />was a work session and only members of the Board of Commissioners and the <br />Planning Board would be allowed to speak. <br /> The Board reviewed the comments contained in the report to the Kannapolis <br />Chamber of Commerce from Mr. Robert M. Leary, Planning Consultant. Changes <br />to the ordinance agreed upon by the Board during the meeting included the <br />following: <br /> <br />(1) <br /> <br />Add the last two sentences of the North Carolina General <br />Statutes 153A-3.4i to the Preamble and Enactment Clause of the <br />Zoning Ordinance. <br /> <br />(2) Substitute the word "structure" for the word "building" in <br /> Section 1.1. <br /> <br />(3) <br /> <br />Insert the word "required" in Section 1.2 for statement to read: <br />"No required open space shall be encroached upon or reduced in any <br />manner to satisfy the requirements of any other lot or specific <br />land use classification except in certain circumstances allowed <br />by 'Planned Development' zoning districts." <br /> <br />(4) <br /> <br />Change Section 1.3 to read: "The following exceptions may apply <br />upon determination by the Zoning Official." Also, in Section 1.3 <br />delete the term "major arterial road or thoroughfare" and substitute <br />"a street designated as an arterial street by the North Carolina <br />Department of Transportation or the Cabarrus County Board of <br />Commissioners." <br /> <br />(5) <br /> <br />(6) <br /> <br />Eliminate paragraphs 1.9 and 1.10 relating to non-conformity and <br />insert content in Section 6. Also, relocate Subsection 4.1 to <br />Section 6 in order to combine all provisions relating to non- <br />conformity in one location in the ordinance. <br /> <br />Substit~ethe term "required front setback" for term "front yard <br />setback" in Section 4.3. <br /> <br />(7) <br /> <br />(8) <br /> <br />(9) <br /> <br />(lO) <br /> <br />(11) <br /> <br />(12) <br /> <br />Add passive solar collectors to the list of items which are not <br />subject to height limitation in Section 4.4. <br /> <br />Insert provision in Section 4.5 that obstructions to vision at <br />intersections should be measured from the central point of the <br />intersection of the two streets involved. <br /> <br />Change Section 4.8 to allow minor division of property among family <br />with a minimum parcel, size of one acre. The Board will define the <br />word "family" at a later date. <br /> <br />Delete paragraphs B and C under Section 5.1 and revise 5.1-A to <br />read: "Ail accessory buildings, structures or uses shall be con- <br />fined to the buildable area of the lot excluding that buildable <br />area in front of the principal structure." <br /> <br /> Delete Subparagraph 5.4-E relating to covenants and deed restrictions. <br /> Relocate Section 5.5-G relating to common open space in a Planned <br /> Unit Residential Development to Sub-Section 3.11 which contains <br /> other regulations for a planned residential development. <br /> <br /> <br />
