585 <br /> <br /> The Board of Commissioners for the County of Cabarrus met in called <br />session at 7:00 P.M. on Thursday, August 20, 1981, in the Superior Courtroom <br />at the County Courthouse in Concord, North Carolina, for the purpose of <br />reviewing the proposed Zoning Ordinance. <br /> Present - Chairman: Ralph C. Bonds <br /> Commissioners: J. Harold Nash <br /> Troy R. Cook <br /> James W. Lentz <br /> Kenneth F. Payne <br /> Members of the Cabarrus County Planning Board present for the meeting <br />were as follows. <br /> <br />Ms. Cynthia Bostick <br />Mr. John Cline <br />Mr. Frank Rankin <br />Mr. Raiford Troutman <br /> <br /> UPON MOTION of Commissioner Nash, seconded by Commissioner Lentz and <br />unanimously carried, the Board moved for the Board of Commissioners and <br />the Planning Board to jointly go into Executive Session with the County <br />Attorney and two members of the Planning Department staff for the <br />purpose of discussing legal aspects of the proposed Zoning Ordinance. <br /> UPON MOTION of Commissioner Lentz, seconded by Commissioner Cook and <br />unanimously carried, the Board moved to terminate the Executive Session. <br /> Chairman Bonds stated the Board had met with the County Attorney <br />during the Executive Session for legal counsel concerning the proposed <br />Zoning Ordinance. <br /> UPON MOTION of Commissioner Lentz, seconded by Commissioner Cook with <br />Commissioners Lentz, Cook, and Payne and Chairman Bonds voting for and <br />Commissioner Nash voting against, the Board agreed to turn over the <br />proposed Zoning Ordinance draft of August 20, 1981, to the Cabarrus <br />County Planning Board for certification. <br /> Mr. John Boger, County Attorney, advised the Board that the County <br />Planning Board would now be responsible for taking action on the revised <br />draft of August 20, 1981, of the proposed Zoning Ordinance. He explained <br />that due to the number of changes made to the document it would be necessary <br />for the Board of Commissioners to call for another public hearing on the <br />proposed Zoning Ordinance after receiving the ordinance from the Planning <br />Board. <br /> Chairman Bonds opened the meeting for comments from the audience. <br /> Mr. Eric Jean Hendley complained that he had been informed on this date <br />that his trailer could not be allowed in its present location as that area <br />was not zoned for mobile homes. He stated he had visited the Building <br />Inspection Department in June and had been told at that time to set his <br />trailer up and an inspector would come out to inspect the trailer when he <br />was ready to have the electricity turned on. Mr. Hendley explained he had <br />gone to the Building Inspection Office again on August 20, 1981, to make <br />arrangements to have his trailer inspected. He stated he had been sent to <br />the Planning Department where he had been informed that his trailer was <br />located in an area which was not zoned to permit mobile homes and that the <br />proposed Zoning Ordinance was retroactive to the date of notice of public <br />hearing. Mr. Hendley requested that his trailer be allowed to remain in <br />its present location. <br /> Chairman Bonds instructed Commissioner Lentz and County Manager Charles <br /> McGinnis to investigate the matter and report their findings at the next <br /> Board meeting. He also requested that some type of arrangement be worked <br /> out between the Building Inspection Department and the Planning Department <br /> to prevent such occurrences in the future. <br /> Mr. Manuel Kiser questioned the legality of the new text of the pro- <br /> posed Zoning Ordinance being retroactive to the date of notification of <br /> the public hearing for the previous draft of the ordinance. <br /> Mr. Jerry Rollins complained about the regulations placed on mobile <br /> homes by the proposed Zoning Ordinance. <br /> Dr. Kenneth Underwood of Kannapolis complained of the zoning restrictions <br /> on his property in Kannapolis. <br /> Mr. Bill Powlas stated that zoning would take away an individual's <br /> freedom to do as he wished with his personal property. <br /> <br /> <br />
