587 <br /> <br /> The Board of Commissioners for the County of Cabarrus met in regular <br />session at the County Courthouse in Concord, North Carolina, on Monday, <br />August 24, 1981, at 7:00 P.M. <br /> Present - Chairman: Ralph C. Bonds <br /> Commissioners: J. Harold Nash <br /> Troy R. Cook <br /> James W. Lentz <br /> Kenneth F. Payne <br /> The invocation was given by Reverend Barry W. Moore of Calvary Free <br />Will Baptist Church. <br /> UPON MOTION of Commissioner Payne~ seconded by Commissioner Lentz <br />and unanimously carried, the minutes of July 8, July 9, July 27, July 30, <br />August 3, and August 4, 1981, were approved as written. <br /> Mr. Eddie Hoglan of Royal Garbaga Service, Mr. William Fisher of <br />J & F Disposal Company, and Mr. Ray Helms of Cabarrus Sanitation Company, <br />Inc., were present to request a rate increase for the franchised garbage <br />collectors in the County. Mr. Fisher explained that a rate increase would <br />enable the refuse collectors to upgrade present service and possibly provide <br />such extended services as the pick up of bagged leaves and tree limbs which <br />have been bundled. <br /> UPON MOTION of Commissioner Lentz, seconded by Commissioner Payne and <br />unanimously carried, the Board agreed to allow the franchised garbage <br />collectors to increase rates by $1.00 per month for refuse collection in <br />Cabarrus County effective October 1, 1981. This action constitutes a rate <br />of $6.00 per month for roadside garbage pick up and $7.00 per month for <br />rear yard garbage service. <br /> Mr. Charles McGinnis, County Manager, reported that bids received for <br /> the annual office supplies contract award were as follows. <br /> <br />LEGAL ADVERTISEMENT DATE: <br />July 1, 1981 <br /> <br /> NAME OF COMPANY <br />Metrolina Office Suppliers <br />Lift-Off Corporation <br /> <br />CERT. CHECK BID BOND TOTAL BID <br />X $13,705.51 <br />X $ 6,365.83 <br /> (INCOMPLETE BID) <br /> <br /> UPON MOTION of Commissioner Cook, seconded by Commissioner Nash and <br />unanimously carried~ ~the Board awarded the bid for office supplies for <br />1981-82 to Metrolina Office Suppliers in the amount of $13,705.51. <br /> UPON MOTION of Commissioner Lentz, seconded by Commissioner Nash and <br />unanimously carried, the~Board moved to go into Executive Session to discuss <br />a~personnel, matter. <br /> UPON MOTION of Commissioner Cook, seconded by Commissioner Lentz and <br />unanimouslycarried, the Board moved to terminate the Executive Session. <br /> Chairman Bonds reported the Board had met with Mr. Gil Johnson of the <br />auditing firm of Sherrill and Smith for an update on the audit of the Tax <br />Collection Department. He reported that Mr. Johnson had informed the Board <br />that 4,468 verifications had been mailed and 213 responses had been received. <br /> 'Mr. Archie Barnhardt complained that the County was not properly enforcing <br />the Cable Television Ordinance. He stated that Vision Cable of Metrolina, <br />the cablevision franchisee in the County, had attached service lines to <br />utility poles owned by him and located on his property without his permission <br />and without any compensation to him. Mr. Barnhardt explained that his <br />attorney had written officials of Vision Cable in February, 1981, advising <br />them that company employees were trespassing, but he stated employees had <br />been back on his property since that time. He requested that the County <br />revoke Vision Cable's franchise as he stated the company had failed to obtain <br />a pole attachment, agreement with him and had refused to compensate him for <br />the use of his poles and a right of way across his property. Mr. Barnhardt <br />also objected to the fact that Vision Cable had discontinued cablevision <br />service to several subscribers who lived in the area served by the lines <br />across his property. In closing, Mr. Barnhardt stated he was not going to <br />sue Vision Cable as the company's attorney was located in New York, but he <br />advised the Board he was going to file legal proceedings against the County <br />unless the Board took appropriate action against Vision Cable and properly <br />enforced the Cable Television Ordinance. <br /> UPON MOTION of Commi'ssioner Cook, seconded by Commissioner Lentz and <br /> unanimously carried, the Board agreed to invite representatives Of Vision <br /> Cable to present their response to Mr. Archie Barnhardt's charges at the <br /> next regular Board meeting. <br /> <br /> <br />
