599 <br /> <br /> The Board of Commissioners for the County of Cabarrus met in regular <br />session at the County Courthouse in Concord, North Carolina, on Monday, <br />October 5, 1981, at 9:30 A.M. <br /> Present - Chairman: Ralph C. Bonds <br /> Commissioners: J. Harold Nash <br /> Troy R. Cook <br /> James W. Lentz <br /> Kenneth F. Payne <br /> The invocation was given by Reverend John Kale of Forest Hill United <br />Methodist Church. <br /> UPON MOTION of Commissioner Cook, seconded by Commissioner Lentz and <br />unanimously carried, the minutes of September 21, 1981, were approved as <br />written. <br /> Mr. John R. Boger, Jr., County Attorney, reviewed the proposed Settlement <br />Agreement between Cabarrus County and Ms. Ethel Honeycutt in the action <br />filed by the County to abate the nuisance created by dogs maintained by <br />Ms. Honeycutt. <br /> UPON MOTION of Commissioner Payne, seconded by Commissioner Lentz and <br />unanimously carried, the Board accepted the following agreement between <br />Cabarrus County and Ms. Ethel Honeycutt. <br /> <br />IN THE GENERAL COURT OF JUSTICE <br />DISTRICT COURT DIVISION <br /> <br />NORTH CAROLINA <br />CABARRUS COUNTY <br /> <br />Cabarrus County, ) <br /> Plaintiff, ) <br /> <br />Ethel A. Honeycutt, ) <br /> Defendant. ) <br /> <br />FILE NO.: 81 CVD 1092 <br />FILM NO.: <br /> <br />SETTLEMENT AGREEMENT <br /> <br /> THIS AGREEMENT, made this 24th day of September, 1981, by and between <br />Ethel A. Honeycutt, a citizen and resident of Cabarrus County, and Cabarrus <br />County, by and through its Board of Commissioners, witnesses: <br /> <br /> 1. That Cabarrus County is a political subdivision of the State of <br />North Carolina. <br /> 2. That Ethel A. Honeycutt is a resident of 613 Fairview Street, <br />Kannapolis, North Carolina. <br /> 3. That the residence of Ethel A. Honeycutt is a small house with a <br />fenced-in back yard, inadequate for the care and restraint of a .large number <br />of dogs. <br /> 4. That defendant now has three (3) dogs at her residence and has kept, <br />at times, eight or more dogs at her residence, which have disturbed her <br />neighbors and occasioned complaints to the Board of Commissioners of Cabarrus <br />County about the condition of the defendants residence and her dogs. <br /> 5. That because they were burdensome to her and caused friction with <br />her neighbors, Ethel A. Honeycutt has disposed of all her dogs except; a <br />predominately shepherd dog answering to the name "Rusty", a 9 year old <br />predominately shepherd dog, answering to the name Princess, and a crippled <br />puppy of uncertain breed, approximately 8 months old. <br /> 6. That on the 25th day of August, 1981, Cabarrus County filed action <br />in the District Court for Cabarrus County captioned 81 CVD 1092 to abate a <br />nuisance allegedly maintained by Ethel A. Honeycutt and defined by the <br />plaintiffs' Board of Commissioners in their regular meeting held on the <br />3rd day of August, 1981. <br /> <br /> NOW, THEREFORE, in consideration of these premises Ethel A. Honeycutt <br />and Cabarrus County by and through its Board of Commissioners hereby agree: <br /> <br /> 1. Ethel A. Honeycutt shall not keep or maintain more than the <br />three (3) dogs she now owns. <br />2. Ethel A. Honeycutt shall keep no vicious and uncontrollable dogs. <br />3. Ethel A. Honeycutt shall keep all of her dogs penned or leashed <br />as required by the ordinances of Cabarrus County and shall comply with all <br />other ordinances and statutes pertaining to the keeping and care of dogs <br />and animals. <br /> <br /> <br />
