634 <br /> <br /> UPON MOTION of Commissioner Lentz, seconded by Commissioner Payne with <br />Commissioners Lentz, Payne, Cook and Bonds voting for and Commissioner Nash <br />voting against, the Board voted to change the one-mile perimeter zoned A-I <br />around the waste treatment plant back to ARR as originally proposed in <br />the ordinance. <br /> UPON MOTION of Commissioner Nash, seconded by Commissioner Payne with <br />Commissioners Nash, Payne, Lentz, and Bonds.voting for and Commissioner Cook <br />voting against, Subsection 5.20-2 Procedure Where Zoning Official Can Make <br />Determination was accepted as it appeared in the original text of the <br />ordinance. <br /> UPON MOTION of Commissioner Cook, seconded by Commissioner Payne and <br />unanimously carried, the original text of Subsection 5.20-3 Procedure Where <br />Zoning Official Cannot Make Final Determination was accepted. <br /> The Board accepted the addition of the following sentence at the end of <br />the paragraph of Subsection 5.21-5 Electrical Disturbance Or Interference - <br />B. Noise : <br /> <br />Within ARR and other residential districts the noise levels may not <br />exceed the noise levels listed under residential usage in Table A as <br />measured from the lot line. <br /> <br /> Subsection 6.3 Intent Concerning Nonconforming Uses was amended to read <br />as follows. <br /> <br />It is the intent of this ordinance that non-conforming uses shall be <br />considered to be incompatible with the permitted uses within the <br />several districts. Such nonconforming uses shall not be enlarged <br />or extended in any respect without a variance from the Board of <br />Adjustment. <br /> <br /> UPON MOTION of Commissioner Payne, seconded by Commissioner Nash with <br />Commissioners Payne, Nash, Lentz, and Cook voting for and Chairman Bonds <br />voting against, the Board accepted the original text of Subsection 6.6 Noncon- <br />forming Uses of Land Without Structures or with Minor Structures with the <br />following amendments. <br /> <br />B. If the use ceases for more than a total of one hundred eighty <br />(180) days subsequent use of the premises shall conform to the district <br />regulations. <br />C. (Deleted) <br /> <br /> UPON MOTION of Commissioner Nash, seconded by Commissioner Payne and <br />unanimously carried, Subsection 6.8 Nonconforming Structures other than <br />Signs was accepted as recommended by the Planning Board. <br /> Subsection 6.10 Repairs and Maintenances was accepted as recommended by <br />the Planning Board. <br /> UPON MOTION of Commissioner Cook, seconded by Commissioner Lentz and <br />unanimously carried, Subsection 6.11 Nonconforming Structures Unsafe for Reasons <br />Other than Lack of Maintenance remained.as recommended by the Planning Board. <br /> UPON MOTION of Commissioner Nash, seconded by Commissioner Cook and <br />unanimously carried, Subsection 7.3 Zoning Compliance Permit was accepted as <br />recommended by Planning Board. <br /> UPON MOTION of Commissioner Nash, seconded by Commissioner Cook and <br />unanimously carried, the Board accepted Subsection 7.4 Application For <br />Certificate of Zoning compliance as recommended by the Planning Board. <br /> UPON MOTION of Commissioner Nash, seconded by Commissioner Cook and <br />unanimously carried, the Board approved Subsection 7.7 Certificates of <br />Occupancy as originally pr~osed with the following sentence to be added to <br />the end of the paragraph. <br /> <br />A temporary permit may be granted up to one hundred eighty (180) days. <br /> <br /> UPON MOTION of Commissioner Nash, seconded by Commissioner Cook and <br />unanimously carried, the Board agreed that Subsection 7.8 Health Approval <br />Required Prior to Issuance of Zoning Compliance Permit And Certificate Of <br />Occupancy should remain as proposed in the original text of the ordinance. <br /> UPON MOTION of Commissioner Lentz, seconded by Commissioner Payne and <br />unanimously carried, the meeting~was adjourned at 10:25 P.M. <br /> <br />Clerk to the Board <br /> <br /> <br />
