10 <br /> <br /> The Board of Commissioners for the County of Cabarrus met at 7:00 P.M. <br />on Tuesday, January 12, 1982, at the Concord Middle School for a public <br />hearing on the proposed "Zoning Ordinance of Cabarrus County, North Carolina, <br />and Official Zoning Atlas of Cabarrus County" as approved and certified to <br />the Board of Commissioners by the Cabarrus County Planning Board. <br /> Present - Chairman: Ralph C. Bonds <br /> Commissioners: J. Harold Nash <br /> Troy R. Cook <br /> James W. Lentz <br /> Kenneth F. Payne <br /> Members of the Cabarrus County Planning Board present for the public <br />hearing were as follows. <br /> <br /> Ms. Cynthia Bostick <br /> Mr. John Cline <br /> Mr. F. A. "Jack" Rankin <br /> Mr. Billy Plummer <br /> Mr. Raiford Troutman <br /> <br /> Mr. Jay Nodine served as moderator for the the public hearing. He <br />stated that the purpose of this public hearing was to receive input from <br />the citizens of the County regarding the proposed ordinance and stated that <br />special attention should be directed to the revisions which had occurred in <br />the June 1981 Proposal as a result of the two public hearings held on <br />July 8, 1981, and July 9, 1981. Mr. Nodine advised that only those persons <br />registered to speak would be allowed to participate in the hearing and that <br />all presentations would be limited to three (3) minutes. <br /> Mr. Manuel Kiser of 32 Flowes Store Road praised the Planning Board for <br />its work on the proposed Zoning Ordinance. He stated that the ordinance <br />now under consideration was not the ordinance certified by the Planning Board <br />as the Planning Director had not written the Planning Board minutes correctly <br />regarding the proposed ordinance. Mr. Kiser charged that the Board of County <br />Commissioners had become involved with special interest groups in the County. <br />He contended that members of the Board of Commissioners had introduced motions <br />for the purpose of zoning their property in a specific manner. <br /> Mr. Bill Powlas protested that the ordinance presently under consideration <br />was not the ordinance returned to the Planning Board in July but was an <br />entirely new ordinance drawn up by Mr. Robert Leary, Planning Consultant. <br />He complained that the Board of Commissioners had not considered the information <br />received at the public hearings in July and that the individual taxpayer has <br />no voice in the proposed ordinance. Mr. Powlas objected to the provision <br />of the ordinance requiring a minimum lot requirement of 60,000 square feet <br />in the A-2 zones. <br /> Ms. Hariett Ward of 800 Isabel Street in Kannapolis urged the Board to <br /> proceed with the enactment of the proposed zoning ordinance, stating the <br /> County needs a plan to insure the legacy of Cabarrus County for future <br /> generations. <br /> Mr. Bryant Baldwin of 6225 Providence Drive spoke in support of zoning. <br /> He requested that the area west of Pitts School Road from Fredrickson Trucking <br /> Company to Poplar Tent Road be reclassified from A-I to ARR, stating that <br /> Pitts School Road in its present condition cannot handle the heavy traffic <br /> generated by businesses in an A-I zone. In addition, Mr. Baldwin asked <br /> that the Board reconsider the addition of building contractor's storage yards <br /> as a permitted use in R-40. <br /> Mr. Ray Calloway opposed any action to establish zoning regulations <br /> throughout the County. He specifically objected to the exclusion of mobile <br /> homes and mobile home parks as a permitted use in any of the districts and <br /> requested that mobile home parks be permitted in the Agricultural and <br /> Industrial zones. Mr. Calloway opposed the offset and setback regulations <br /> for display or sales lots and the requirement of a minimum lot size of <br /> 60,000 square feet for any area in Cabarrus County. He recommended the <br /> deletion of the provision pertaining to nonconforming uses on page 79 of <br /> the ordinance as he stated that particular provision was unclear and in <br /> conflict with Section VI-Nonconformities. <br /> Mr. Ervin Spainhour, attorney representing the M. S. Lyles estate, <br /> reiterated his previous request that sections of that 500-acre tract of land <br /> be rezoned. Also appearing as representative of 500 residents, churches, and <br /> landowners of the community near Highway 601 and Joyner Road where a race <br /> track is being constructed, Mr. Spainhour requested that the Board enact the <br /> proposed zoning ordinance as it relates to Township 10 as soon as possible. <br /> Ms. Grace J. Bryant'of the Bethel Community in Kannapolis stated support <br /> of the proposed zoning ordinanance and viewed it as a means of having the <br /> wrecked cars located on Centergrove Road removed. She explained that the cars <br /> were dangerous for children playing in the area and were a breeding place for <br /> rats which could spread disease throughout the community. <br /> <br /> <br />
