24 <br /> <br /> The Board of Commissioners ~or the County of Cabarrus met at 7:00 P.M. <br />on Tuesday, January 26, 1982, in the Commissioners Room at the County Courthouse <br />for the purpose of reviewing the proposed Zoning Ordinance and Atlas as <br />certified by the Cabarrus County Planning Board and to approve any intended <br />changes to be made at the time of adoption of the ordinance. <br /> Present - Chairman: Ralph C. Bonds <br /> Commissioners: J. Harold Nash <br /> Troy R. Cook <br /> James W. Lentz <br /> Kenneth F. Payne <br /> Members of the Planning Board present for the meeting were as follows. <br /> <br />Mr. Billy Plummer <br />Mr. John Cline <br />Mr. F. A. "Jack" Rankin <br />Mr. Raiford Troutman <br /> <br /> Ms. Rosemary McLean, Planning staff member, recorded the actions of the <br />Board at this meeting. <br /> Mr. Bill Powlas requested that the minimum lot size in the ARR zones <br />be decreased to 30,000 square feet. In addition, he asked that the minutes <br />of the public hearing be considered by the Board of Commissioners before <br />the proposed Zoning Ordinance and Atlas is adopted. <br /> A Mr. Helms, a builder in Cabarrus County, also requested that the <br />minimum lot size in the ARR zone be changed to 30,000 square feet. <br /> Mr. Larry Williams of the Cabarrus County Home Builders Association <br />informed the Board that the Farmers Home Administration could not provide <br />loans for property over one acre in size. <br /> Dr. Paul Gundlach, authority on noise levels, addressed the Board <br />regarding the noise section of the proposed ordinance. He noted that the <br />technical aspects of noise levels are difficult to understand and demonstrated <br />how to read decibel levels using a typical Type II sound meter. <br /> UPON MOTION of Chairman Bonds, seconded by Commissioner Nash with <br />Chairman Bonds and Commissioners Nash and Payne voting for and Commissioners <br />Cook and Lentz voting against, the Board moved to lower the minimum lot <br />size in the A-2 district to that of the ARR zone which was 50,000 square <br />feet. <br /> UPON MOTION of Commissioner Nash, seconded by Commissioner Payne and <br />unanimously carried, the Board voted to delete the word "nonconforming" in <br />Section 5.7 Screening Nonconforming Salvage Yards and thereby requiring <br />all salvage yards to be screened. <br /> UPON MOTION of Commissioner Payne, seconded by Commissioner Lentz and <br /> unanimously carried, the Board approved the addition of the following <br /> subsection in the proposed Zoning Ordinance <br /> <br /> 6.14 Continuance of Nonconforming Mobile Home Parks: Ail non- <br /> conforming uses of land without structures or minor structures on <br /> it for mobile home parks (those not granted a conditional use in <br /> accordance with the ordinance) may continue provided that the <br /> arrangement of the spaces is not altered and the number of spaces <br /> is not increased. In the absence of a plat recorded in the <br /> Cabarrus County Register of Deeds office prior to June 30, 1981, <br /> records in the Cabarrus County Tax Supervisor's office will be <br /> utilized as verification reflecting the number of lots the <br /> individual paid taxes on. <br /> <br /> UPON MOTION of Commissioner Cook, seconded by Commissioner Lentz and <br />unanimously carried, the Board adopted all changes which had been recommended <br />by the Board of Commissioners to the proposed Zoning Ordinance and Atlas <br />certified to them by the Cabarrus County Planning Department. Ail changes <br />are to be incorporated into the text of the proposed ordinance. <br /> UPON MOTION of Commissioner Nash, seconded by Commissioner Cook and <br />unanimously carried, the Board moved that all changes made at this meeting <br />of the Board of Commissioners be incorporated into the Zoning Ordinance. <br /> UPON MOTION of Chairman Bonds, seconded by Commissioner Nash with <br />Chairman Bonds and Commissioners Nash, Cook, and Payne voting for and <br />Commissioner Lentz voting against, the Board agreed to change sections <br />of the M. S. Lyles 500-acre tract of land from the classification of A-I <br />to I-1 and 1-2 and to change that section of land between Buff-Peach Orchard <br />Road and Highway 73 West from A-I to C-4. Exact boundary lines for each <br />zone are delineated on Sheet 5601 (Township 2) and Sheet 5601 (Township 4) <br />of the official Zoning Atlas. <br /> <br /> <br />
