Stewart of Acoustical Consultants, Inc. <br /> UPON MOTION of Commissioner Payne, seconded by Commissioner Cook and <br />unanimously carried, the Board approved the following maximum permissible <br />noise levels to be incorporated into Table A - Maximum Permitted Equivalent <br />Sound Levels db(A) - of the proposed Zoning Ordinance. <br /> <br /> Day Evening <br />Residential 60 55 <br />Commercial 65 60 <br />Industry 85 75 <br /> <br /> UPON MOTION of Commissioner Cook, seconded by Commissioner Payne and <br />unanimously carried, the Board voted to combine the zones of I-1 and 1-2 <br />with the other zones listed on Table A - Maximum Permitted Equivalent Sound <br />Levels db(A) - in order that the above stated maximum permissible noise <br />levels are applic~able to all zones listed on Table A. <br /> UPON MOTION of Commissioner Cook, seconded by Commissioner Nash and <br />unanimously carried, the Board agreed to set up new section in the proposed <br />Zoning Ordinance pertaining specifically to noise. <br /> UPON MOTION of Commissioner Nash, seconded by Commissioner Cook and <br />unanimously carried, the Board agreed to change the word "impact" in Note B(2) <br />of Table A in the proposed zoning ordinance to read ,short duration." <br /> UPON MOTION of Commissioner Cook, seconded by Commissioner Payne and <br />unanimously carried, the Board agreed to enact the following provision <br />pertaining to Special Events in the proposed Zoning Ordinance. <br /> <br />Recognizing that there are a certain number of special event~ usually <br />celebration events of local importance (i.e., County Fair, Christmas <br />parades, 4th of July celebrations) or major commercial events providing <br />significant economic benefit to the County and drawing at least fifty <br />percent (50%) of spectators from out of the state, special provisions <br />should be set forth to exclude these events from the noise~ level in <br />Table A. <br /> <br />Noise levels which may exceed the specified levels set forth in Table A <br />are permitted on a limited basis by securing.a permit from the Zoning <br />Official provided that not more than eight permits for a single event <br />or consecutive day events are granted to a applicant per year. <br /> <br />Special events held by and governed by public schools, private schools <br />(approved by the North Carolina Department of Education), colleges <br />or universities (granting bachelor degrees or associate degrees)(i.e., <br />football, soccer, track, base ball and similar or related sporting <br />events, school band practices and competition) are not subjected to <br />the noise section of this ordinance. <br /> <br /> UPON MOTION of Commissioner Lentz, seconded by Commissioner Cook with <br />Commissioners Lentz, Cook, and Payne voting for and Chairman Bonds and <br />Commissioner Nash voting against, the Board agreed to change the minimum <br />lot size in the A-2 and ARR zones to one acre to be consistent with <br />the required one-acre minimum lot size in the A-I zone. <br /> UPON MOTION of Commissioner Cook, seconded by Commissioner Payne with <br />Commissioners Cook, Payne, Lentz, and Nash voting for and Chairman Bonds <br />voting against, the Board agreed to rezone that section of land from <br />Highway 73 West up the center of Afton Run Branch to Mooresville Road from <br />ARR to R-40 in order to tie the two existing zones of R-40 together. This <br />section would include the land east of the creek to the existing boundary <br />line of the next zone. <br /> UPON MOTION of Commissioner Lentz, seconded by Commissioner Payne and <br />unanimously carried, the Board adopted the Cabarrus County Zoning Ordinance <br />and Atlas as certified by the Cabarrus County Planning Board with amendments. <br />Effective date of the Zoning Ordinance and Atlas is February 1, 1982. By <br />reference the Zoning Ordinance is contained in the Cabarrus County Ordinance <br />Book and the Zoning Atlas is on file in the office of the Zoning Administrator <br />in the Cabarrus County Courthouse. <br /> <br /> <br />
