52 <br /> <br />11. <br /> <br />RESPONSE: <br /> <br />Correction of Section 5.21-6. <br /> <br />1) <br /> <br />Correction of 5.21-6 to reflect the following: <br /> <br />Need to reinstate paragraph A of old ordinance. "A decibel is a <br />measure of a unit of sound pressure. Sound waves having the same <br />decibel level "sound" louder or softer to the human ear depending <br />upon the frequency of the sound wave in cycles per sound (i.e., <br />whether the pitch of the sound is high or low). Thus, an A-weighted <br />filter, constructed in accordance with the specifications of the <br />American National Standards Institute (ANSI), type II meter which <br />automatically takes account of the varying effect on the human ear <br />of different pitches shall be used on any sound level measurements <br />required by this section. Accordingly, all measurements are <br />expressed in db (A) to relect the use of this A-weighted filter. <br />The meter shall be calibrated in accord with ANSI before and after <br />testing." <br /> <br />2) <br /> <br />The chart heading should read as follows: <br /> Maximum Permitted Equivalent Sound Levels db (A). <br /> <br />3) In the current note A, the following changes should be made: <br /> <br />Paragraph 1: (leg) changed to (Leq) and this sentence <br /> added to the end. <br /> <br />"The readings may also be obtained using a type II intergrating <br />sound level meter over a 17 minute period." <br /> <br />(This meter gives digital read-outs every 10 seconds.) <br /> <br /> Mr. Bill Plummer, Planning Board member, stated that a certain hour <br />should be specified in the ordinance to consider the noise level. Mr. <br />Manuel Kiser questioned the rights of the property owner when a complaint <br />is made against him regarding noise. Mrs. Yvonne Furr, developer of new <br />race track in the county, complained that the noise regulations in the <br />ordinance were enacted specifically in regards to the race track and <br />requested clarification of the noise provisions of the ordinance and the <br />way in which the noise levels are to be checked. <br /> UPON MOTION of Commissioner Payne, seconded by Commissioner Lentz and <br />unanimously carried, the Board tabled Amendment 11. <br /> UPON MOTION of Commissioner Cook, seconded by Commissioner Lentz and <br />unanimously carried, the Board agreed to refer the tabled amendments of <br />3, 9, and 11 back to the Planning Board. <br /> Ms. Rosemary McLean, member of the Planning Board staff, reviewed <br />proposed amendments to the Zoning Atlas. These amendments were proposed <br />to correct errors which had occurred during remapping during preparation <br />of the Atlas. The proposed Zoning Atlas Amendments were as follows. <br /> <br />1. Map 5623 a proposed zone change from R-7.2 to C-2 in Kannapolis <br /> (PIN's 6000, 4467, 2640, 4550). <br /> <br />2. Map 5613(15) a proposed change from C-2 to RMF-6 in Kannapolis (PIN's <br /> 0837, 0753, 0609). <br /> <br />3. Amendment to include previously omitted maps: <br /> TWP 11: 5529; 5529(09); 5529(16); 5539(13)~ 5529(12); 5539(09) <br /> <br /> No one spoke either for or against these proposed amendments. <br /> UPON MOTION of Commissioner Lentz, seconded by Commissioner Payne and <br />unanimously carried, the Board adopted the Zoning Atlas Amendments as <br />recommended. <br /> Mr. Mmnuel Kiser commended the Planning Board for their work regarding <br />the proposed amendments and stated that confusion existed among the members <br />regarding the recommendations because the minutes of the last Planning <br />Board meeting had not as yet been made available to the members. <br /> Chairman Bonds adjourned the public hearing at 10:35 P.M. He recon- <br />vened the regular meeting of the Board in the Commissioners' Meeting Room <br />at 10:50 P.M. <br /> <br /> <br />
