85 to its books, records, accounts, other sources of information, and its facilities as may be determined by the Department or the Federal Highway Administration to be pertinent to ascertain compliance with such Regulations, orders and instructions. Where any information required of the Agency is in the exclusive possession of another who fails or refuses to furnish this information, the Agency shall so certify to the Department, or the Federal Highway Administration as appropriate, and shall set forth what efforts it has made to obtain the information. (e) Sanctions for Noncompliance; In the event of the Agency's noncompliance with the nondiscrimination provisions of this contract, the Department shall impose such contract sanctions as it or the Federal Highway Administration may determine to be appropriate, including, but not limited to: (1) Withholding of payments to the Agency under the Agreement until the Agency complies, and/or, (2) Cancellation, termination or suspension of the Agreement in whole or in part. (f) Incorporation of Provisions: The County of Cabarrus on behalf of the Agency will include the provisions of this Paragraph 3 in every subcontract, including procurements of materials and leases of equipment, pursuant thereto. The County of Cabarrus will take such action with respect to any subcontract, procure- ment, or lease as the Department or the Federal Highway Administration may direct as a means of enforcing such provisions including sanctions for noncompliance. Provided, however, that in the event the County of Cabarrus becomes involved in, or is threatened With litigation with a subcontractor, supplier, or leaser as a result of such direction, the County of Cabarrus may request the State to enter into such litigation to protect the interests of the State, and, in addition, the County of Cabarrus may request the United States to enter into such litigation to protect the interest of the United States. UPON MOTION of Commissioner Payne, seconded by Commissioner Nash and unanimously carried, the Board agreed to meet for a public hearing to consider Zoning text and map amendments at 7:00 P.M. on the first Thursday of each odd month during the calendar year. UPON MOTION of Commissioner Nash, seconded by Commissioner Payne and unanimously carried, the Board resolved that it was the wishes of the Board of Commissioners that the Planning Board proceed with the development of a mobile home ordinance dealing specifically with non-owner occupied units. Commissioner Nash introduced discussion with Sheriff J. B. Roberts regarding the problem of littering of the public roads throughout Cabarrus County and specifically in the vicinity of the Sanitary Landfill. Sheriff Roberts stated that his department would make an extra effort to patrol the public roads to the Sanitary Landfill to reduce the problem of littering in that area. Sheriff J. B. Roberts reported that he did not have the necessary personnel to enforce the Courthouse parking lot regulations. He recommended that an employee be hired to work the parking lot or that the County install a gate at the p~rking lot entr~mce.which would operate on a token or passcard system. Mr. Charles McGinnis, County Manger, requested the Board's approval of the list of questions and answers he had previously submitted to them regarding the water and sewer bond issue. No objections were made by members of the Board and approval will be given to the Concord Chamber of Commerce to publish these questions and answers to be made available to the public. UPON MOTION of Commissioner Lentz, seconded by Commissioner Cook and unanimously carried, the meeting was adjourned. Clerk to the Board
