85 <br /> <br />to its books, records, accounts, other sources of information, <br />and its facilities as may be determined by the Department or the <br />Federal Highway Administration to be pertinent to ascertain <br />compliance with such Regulations, orders and instructions. <br />Where any information required of the Agency is in the exclusive <br />possession of another who fails or refuses to furnish this <br />information, the Agency shall so certify to the Department, <br />or the Federal Highway Administration as appropriate, and shall <br />set forth what efforts it has made to obtain the information. <br /> <br />(e) Sanctions for Noncompliance; In the event of the Agency's <br />noncompliance with the nondiscrimination provisions of this <br />contract, the Department shall impose such contract sanctions as <br />it or the Federal Highway Administration may determine to be <br />appropriate, including, but not limited to: <br /> <br />(1) Withholding of payments to the Agency under the <br /> Agreement until the Agency complies, and/or, <br />(2) Cancellation, termination or suspension of the <br /> Agreement in whole or in part. <br /> <br />(f) Incorporation of Provisions: The County of Cabarrus on <br />behalf of the Agency will include the provisions of this Paragraph 3 <br />in every subcontract, including procurements of materials and <br />leases of equipment, pursuant thereto. The County of Cabarrus <br />will take such action with respect to any subcontract, procure- <br />ment, or lease as the Department or the Federal Highway Administration <br />may direct as a means of enforcing such provisions including <br />sanctions for noncompliance. Provided, however, that in the event <br />the County of Cabarrus becomes involved in, or is threatened With <br />litigation with a subcontractor, supplier, or leaser as a result <br />of such direction, the County of Cabarrus may request the State <br />to enter into such litigation to protect the interests of the <br />State, and, in addition, the County of Cabarrus may request the <br />United States to enter into such litigation to protect the <br />interest of the United States. <br /> <br /> UPON MOTION of Commissioner Payne, seconded by Commissioner Nash and <br />unanimously carried, the Board agreed to meet for a public hearing to <br />consider Zoning text and map amendments at 7:00 P.M. on the first Thursday <br />of each odd month during the calendar year. <br /> UPON MOTION of Commissioner Nash, seconded by Commissioner Payne and <br />unanimously carried, the Board resolved that it was the wishes of the <br />Board of Commissioners that the Planning Board proceed with the development <br />of a mobile home ordinance dealing specifically with non-owner occupied <br />units. <br /> Commissioner Nash introduced discussion with Sheriff J. B. Roberts <br />regarding the problem of littering of the public roads throughout Cabarrus <br />County and specifically in the vicinity of the Sanitary Landfill. Sheriff <br />Roberts stated that his department would make an extra effort to patrol <br />the public roads to the Sanitary Landfill to reduce the problem of littering <br />in that area. <br /> Sheriff J. B. Roberts reported that he did not have the necessary <br />personnel to enforce the Courthouse parking lot regulations. He recommended <br />that an employee be hired to work the parking lot or that the County <br />install a gate at the p~rking lot entr~mce.which would operate on a token <br />or passcard system. <br /> Mr. Charles McGinnis, County Manger, requested the Board's approval <br />of the list of questions and answers he had previously submitted to them <br />regarding the water and sewer bond issue. No objections were made by <br />members of the Board and approval will be given to the Concord Chamber of <br />Commerce to publish these questions and answers to be made available to <br />the public. <br /> UPON MOTION of Commissioner Lentz, seconded by Commissioner Cook and <br />unanimously carried, the meeting was adjourned. <br /> <br />Clerk to the Board <br /> <br /> <br />
