84 (d) The Agency will furnish all information and reports required by Executive Order 11246 of September 24, 1965, and by the rules, regulations and orders of the Secretary of Labor, or pursuant thereto, and will permit access to its books, records and accounts by the Federal Highway Administration and the Secretary of Labor for purposes of investigation to ascertain compliance with such rules, regulations and orders. (e) in the event of Agency noncompliance with the non-discrimi- nation clauses of this Agreement or with any of the .said rules, regulations or orders, this Agreement may be cancelled, terminated or suspended in whole or in part and the Agency may be declared ineligible for further Government contracts or Federally-assisted construction contracts in accordance with procedures authorized in Executive Order 11246 of September 24, 1965, and such other sanctions may be imposed and remedies invoked as provided in Executive Order 11246 of September 24, 1965, or by rule, regulation or order of the Secretary of Labor, or as otherwise provided by law. (f) The County of Cabarrus on behalf of the Agency will include the provisions of this Attachment in every subcontract or purchase order unless exempted by rules, regulations or orders of the Secretary of Labor issued pursuant to Section 204 of the Executive Order 11246 of September 24, 1965, so that such provisions will be binding upon each subcontractor or vendor. The County of Cabarrus will take such action with respect to any subcontract or purchase order as the Department or the Federal Highway Administration may direct as a means of enforcing such provisions including sanctions for noncompliance: Provided, however, that in the event the County of Cabarrus becomes involved in, or is threatened with litigation with a subcontractor or vendor as a result of such direction by the Federal Highway Administration, the County of Cabarrus may request the United States to enter into such litigation to protect the interests of the United States. 3. Selection of Subcontractors, Procurement of Materials, and Leasing of Equipment During the performance of this Agreement, the County of Cabarrus on behalf of the Agency for itself, its assignees, and successors in interest, agrees as follows: (a) Compliance with Regulations; The Agency will comply with the Regulations of the U. S. Department of Transportation relative to nondiscrimination in Federally-assisted programs of the U. S. Department of Transportation {Title 49, Code of Federal Regulations, Part 21, hereinafter referred to as the Regulations), which are herein incorporated by reference and made part of this Agreement. (b) Nondiscrimination; The Agency with regard to the work performed by it after award and prior to completion of the Agreement work, will not discriminate on the ground of race, color, or national origin in the selection and retention of sub- contractors, including procurements of materials and leases of equipment. The Agency will not participate either directly or indirectly in the discrimination prohibited by Section 21.5 of the Regulations, including employment practices when the Agreement covers a program set forth in Appendix B of the Regulations. (c) The Agency will further comply with the Regulations contained in Title 40, Code of Federal Regulations, Part 23, concerning the development of a minority business enterprise affirmative action program.
