114 <br /> <br />23. No person shall dump, dispose of, or otherwise release any <br /> substance that pollutes or degrades the parks lake and streams. <br />24. ~ No person shall solicit, peddle or beg within any Recreation <br /> Facility, or sell any merchandise or wares; provided, that this <br /> subsection shall not apply to (i)any concession granted by the <br /> Recreation Department for a Recreation Facility, or (ii) any <br /> solicitation or sale of goods by nonprofit or civic groups, <br /> provided that a permit is obtained in advance from the Recreation <br /> Director or his designee, but no such permit shall be issued to <br /> any group more often than once every six months. <br /> <br />SECTION II VIOLATION <br /> <br />CATEGORY I OFFENSES <br />In addition to any other penalties and punishment authorized by law, a <br />violation of~Category I Offenses of this Ordinance is a misdemeanor <br />and is punishable by a fine of not more than Fifty Dollars ($50.00) <br />and imprisonment of not more than thirty (30) days, or both such fine <br />and imprisonment. In addition, the Director of Parks and Recreation, <br />or his designee, may immediately expel said person from the Park and <br />said person shall not be allowed to return for such a period of time, <br />not to exceed thirty (30) days, as may be designated by the Director of <br />Parks and Recreation, or his designee. <br /> <br />Bo <br /> <br />CATEGORY II'OFFENSES <br />Violation of Category II Offenses of this Ordinance is punishable by <br />immediate expulsion from the Park and suspension from said Park for <br />a period of not more than thirty (30) days. The Director of Parks and <br />Recreation, or his designee, is empowered to make said expulsion and <br />invoke said suspension. <br /> <br />SECTION III INJUNCTIVE RELIEF AVAILABLE <br /> <br /> This Ordinance may be enforced by any appropriate remedy authorized by <br /> GS 153A-123. <br /> <br />SECTION IV SEVERABILITY <br /> <br />If any provision'~Of this Ordinance or its application to any person or <br />circumstances is held invalid, such invalidity shall not affect other <br />provisions or applications of the Ordinance which can be given effect <br />without the invalid provision or application, and to this end the provisions <br />of this Ordinance are declared to be severable. <br /> <br />SECTION V EFFECTIVE~ DATE <br /> <br />This Ordinance becomes effective upon its adoption. <br /> <br />CABARRUS COUNTY <br />BOARD OF COMMISSIONERS <br /> <br />By: /s/ Ralph C.
