122 <br /> <br /> (b) The following acts, among others, are declared to be loud, dis- <br />turbing and unnecessary noises in violation of this Ordinance, but said <br />enumeration shall not be deemed to be exclusive, namely: <br /> <br /> (1) The sounding of any horn or signal device on any automobile, <br />motorcycle, bus or other vehicle while not in motion, except as a danger <br />signal if another vehicle is approaching apparently out of control, or <br />if in motion only as a danger signal; the creation by means of any such <br />signal device of any unreasonable loud or harsh sound; and the sounding of <br />such device for an unnecessary and unreasonable period of time. <br /> <br /> (2) The playing of any radio, phonograph or any musical instrument <br />in such a manner or with such volume, particularly during hours between <br />11:00 P.M. and 7:00 A.M. as to annoy or disturb the quiet, comfort or <br />repose of any person in any dwelling, hotel or other type of residence. <br /> <br /> (3) The use of any automobile, motorcycle, or vehicle so out of <br /> repair, so loaded or in such manner as to create loud or unnecessary grating, <br /> grinding, rattling or other noise. <br /> <br /> (4) The creation of any excessive and unreasonable noise on any <br /> street adjacent to any school, institution of learning, library or court <br /> while the same is in session, or adjacent to any hospital, or any church <br /> services, which unreasonably interferes with the working of such institution. <br /> <br /> (5) The shouting and crying of peddlers, hawkers, venders, which dis- <br /> turbs the quiet and peace of the neighborhood. <br /> <br /> (6) The use of any drum, loud speaker or other instrument or device <br /> for the purpose of attracting attention by creation of noise for any per- <br /> formance, show, sale, display or advertisement of' merchandise, or any <br /> other commercial or non-commercial purpose, unless the permission of the <br /> Cabarrus County Board of Commissioners has been given. <br /> <br /> Section 2. Any person violating the provisions of this ordinance <br />shall be guilty of a misdemeanor and upon conviction shall be fined in <br />the discretion of the Court not to exceed $50.00 or 30 days or by both <br />such fine and imprisonment. <br /> <br />This ordinance shall become effective upon its adoption. <br /> <br />This the 7th day of June, 1982. <br /> <br /> /s/ Ralph C. Bonds ~ <br /> Ralph Bonds, Chairman <br /> Cabarrus County Board of Commissioners <br /> <br /> UPON MOTION of Commissioner Payne, seconded by Commissioner Cook and <br />unanimously carried, the Board adopted the following resolution authorizing <br />Cabarrus County to become a participating member of the North Carolina <br />Association of County Commissioners Joint Risk Management Agency Workers' <br />Compensation Fund. <br /> <br />RESOLUTION TO ADOPT THE INTERLOCAL AGREEMENT AND TO JOIN THE <br /> NORTH CAROLINA ASSOCIATION OF COUNTY COMMISSIONERS <br /> JOINT RISK MANAGEMENT AGENCY WORKERS' COMPENSATION FUND <br /> <br /> WHEREAS, Cabarrus County is required to provide payment of workers' <br />compensation claims of employees; and <br /> <br /> WHEREAS, the North Carolina Association of County Commissioners <br />Joint Risk Management Agency has been established by counties pursuant <br />to G. S. 153A-445(a) (1) and G. S. 160A-460 through 160A-464; and <br /> <br /> WHEREAS, it is desirable~for Cabarrus County to join the North <br />Carolina Association of County Commissioners Joint Risk Management Agency <br />and participate in its workers' compensation fund in order to provide a <br />method of risk sharing for workers' compensation claims of its employees; <br /> <br /> <br />
