125 <br /> <br /> SECTION 2. A fire department desiring financial assistance under <br />this resolution shall file a budget request with the Board of County <br />Commissioners of Cabarrus County by the first day of May each year for <br />the following fiscal year. <br /> <br /> SECTION 3. The county fire marshal shall make regular ±nspections <br />of each fire department receiving payments under this resolution. At least <br />one inspection shall be made annually but the fire marshal may make other <br />such inspections as deemed necessary. During the course of such inspections <br />the fire marshal shall determine whether the department is continuing to <br />meet the minimum standards as herein specified, and the findings reported <br />to the Board of Commissioners. <br /> <br /> SECTION 4. If during any inspection the fire marshal determines <br />that the fire department is not meeting the minimum standards as set forth <br />in this resolution, a notice of deficiency must be given in writing by the <br />fire marshal to the fire chief and at least two members of the corporation <br />of the fire department. This notice shall specify the period of time within <br />which the deficiencies must be corrected, provided that the length of said <br />period of time shall be reasonable and in any event shall not be less than <br />fifteen days. At the end of the specified period, an inspection shall <br />be made by the fire marshal to determine if the deficienceis have been <br />corrected. If the deficiencies have not been corrected, the f±re marshal <br />shall notify the Board of County Commissioners and the monthly payments <br />shall cease until such time as the department shall meet the minimum <br />standards of the resolution. <br /> <br /> SECTION 5. Each fire department desiring to qualify for financial <br />assistance under this resolution shall meet the following minimum standards: <br /> <br /> (a) A rural fire department shall be incorporated under the laws <br />of the State of North Carolina. A municipal fire department shall be or- <br />ganized under an ordinance of the governing~body of the incorporated city <br />or town. Fire departments shall respond to calls on a non-discriminating <br />basis within Cabarrus County. <br /> <br /> (b) Each fire department shall have a fire chief, an assistant <br />chief, other necessary officers and personnel with a minimum of nineteen <br />(19) fire fighters who are "eligible firemen" in accordance with G.S. 118-23. <br />A list of all members, and their address, telephone numbers, and social <br />security numbers must be given to the fire marshal on or before July 1 of <br />each year and within 10 days of the addition of new members. <br /> <br /> (c) Ail active members of a fire department in good standing shall <br />have some identification, such as a card, badge or car plate to identify them <br />as a "bona fide fire ~fighter". No one other than an active member in good <br />standing shall be allowed to have this identification in his possession. <br /> <br /> (d) Each fire department shall have and maintain at least a <br />Class 9 rating with the Insurance Services Office. Efforts should be made <br />toward receiving lower ratings by each department through equipment purchases <br />and water supply development. Ail equipment specified shall be kept in good <br />condition and operative at all times. <br /> <br /> (e) Each department shall carry liability insurance on its personnel <br />and equipment, leaving the county free from any responsibility for damages <br />or claims resulting from the activities of its fire fighters or from the <br />operation of its equipment. Each fire department shall also carry workmen's <br />compensation insurance on its active members in order to provide those <br />members with the benefits of the Workmen's Compensation Act. <br /> <br /> (f) Each fire department shall carry out an organized training <br />program which shall provide a minimum of thirty-six (36) hours per year <br />training. The training program shall include the training and qualifying <br />of apparatus drivers. Written records shall be kept on all drills and <br />include subject taught, instructor, hours, and members attending. <br /> <br /> (g) The fire chief for each department is responsible for stressing <br />"safety" throughout the department and all phases of the department's <br />activities. Emphasis shall be placed on safe driving of department owned <br /> <br /> <br />
