168 <br /> <br /> The Board of Commissioners for the County of Cabarrus met at 7:00 P.M. <br />on Thursday, September 2, 1982, in Courtroom 2 at the County Courthouse in <br />Concord, North Carolina, for a public hearing regarding Zoning Atlas and <br />Text amendments. <br /> Present - Chairman: Ralph C. Bonds <br /> Commissioners: J. Harold Nash <br /> Troy R. Cook <br /> James W. Lentz <br /> Kenneth F. Payne <br /> Mr. Raiford Troutman, Chairman of the Cabarrus County Planning Board, <br />presented each of the proposed Zoning Atlas and Text changes for the <br />Board's consideration. He recognized Mr. Jim Owens, Interim Planning <br />Director, who reviewed the location of each of the areas proposed for <br />rezoning. <br /> <br />ZONING ATLAS AMENDMENTS <br /> <br />(1) <br /> <br />Jim Moser. Petition Number 82-04. Tabled from July 1st Commissioners <br />Meeting. Township 4, South Main Street (closest intersection Cresent <br />Street and South Main Street). Request to rezone single family <br />dwelling from R-9 to C-3. Map/PIN 5612(07)-79-7434, 5612(07)-79-9412. <br />Denied by Planning Board. <br /> <br /> No one was present to speak either for or against this rezoning request. <br />UPON MOTION of Commissioner Payne, seconded by Commissioner Nash and <br />unanimously carried, the Board denied the rezoning request by Mr. Jim Moser. <br /> <br />(2) <br /> <br />Concord/Kannapolis Broadcasting Company. Petition Number 82-09. <br />Township 4. Off of Collingswood Drive. Propose change from R-15 to <br />C-3. 5611-63-9780. Passed by Planning Board 8-11-82 unanimously. <br /> <br /> Mr. Marvin Stallings, resident of 268 Collingswood Drive, opposed the <br />rezoning of this property from R-15 to C-3, stating the rezoning of this <br />area would lower the property value along Collingswood Drive and would <br />endanger the lives of the children in the neighborhood. He presented <br />a petition signed by other residents of Collingswood Drive who were opposed <br />to the rezoning request. <br /> Ms. Nancy Cooper, Manager of WPEG, requested the rezoning of this <br />property in order to allow the Concord/Kannapolis Broadcasting Company to <br />establish a broadcasting station and tower at the site. She explained that <br />the tower was needed immediately but that the construction of a new station <br />was not planned for several years. Mr. Raiford Troutman, member of the <br />Board of Directors of WPEG, spoke in favor of rezoning that portion of the <br />property to be used for the immediate erection of a tower by the Concord/ <br />KannapolisBroadcasting Company. <br /> UPON MOTION of Commissioner Nash, seconded by Commissioner Cook and <br />unanimously carried, the Board agreed to rezone to C-3 the portion of <br />property of Concord/Kannapolis Broadcasting Company that lies south of a <br />line extending from Irish Buffalo Creek in an easterly direction, said line <br />to be parallel with and 200 feet south of Collingswood Drive. <br /> <br />(3) <br /> <br />Helen F. & John A. Atkins. Petition Number 82-10. Township 2. <br />Off of Poplar Tent Road. Propose change from R-40 to ARR. 4680-68-0277. <br />Passed by the Planning Board 8-11-82 unanimously. <br /> <br /> Mr. Jim Scarbrough, attorney representing Mr. and Mrs. John Atkins, <br />spoke in favor of the rezoning request to bring the restaurant located <br />on this property into conformity. No one stated opposition to the rezoning <br />of this property. <br /> UPON MOTION of Commissioner Cook, seconded by Chairman Bonds and <br />unanimously carried, the Board approved the rezoning from R-40 to ARR on <br />PIN 4680-68-0277 as requested. <br /> <br />(4) <br /> <br />Crawford W. Porter. Petition Number 82-11. Township 2. Poplar Tent <br />area. Propose change from R-15 to R-30.
