170 <br /> <br />neighborhood, stating that this type housing would lower the value of homes <br />in the area, increase the number of vehicles, endanger the children's safety, <br />and create drainage problems. Mr. Gene Massey of Elwood Street objected to <br />the increase in the density of the population that the proposed zoning would <br />permit. Mrs. Schaly Brooks of Meadowood Circle spoke on present and future <br />traffic problems in the area. Other residents speaking against the proposed <br />zoning included Ms. Frances Freeze and Messrs. Frank Almond, R. S. Murphy, <br />and Eric Linker. <br /> Mr. Gene Holbrooks, owner of the property, spoke in favor of zoning <br />the parcel of land as RMF-6. He advised the Board of the need for additional <br />multi-family housing in the County and stated that this property was the <br />ideal location.for such housing because of the availability of water and <br />sewer and the proximity to a main artery between Concord and Kannapolis. <br />Also speaking in favor of the proposed zoning were Messrs. Rod Holbrooks <br />and Carl Moore. <br /> UPON MOTION of Commissioner Lentz, seconded by Commissioner Payne and <br />unanimously carried, the Board denied the request to zone this property <br />as RMF-6. <br /> Motion made by Commissioner Nash to zone the property RMF-7 failed for <br />lack of second. <br /> UPON MOTION of Commissioner Lentz, seconded by Commissioner Payne and <br />unanimously carried, the Board moved that this property'in question be <br />zoned R-9 as recommended by the Planning Board. <br /> <br />ZONING TEXT CHANGE <br /> <br />(1) <br /> <br />Suggested change reference page 16, Section 3.2-4 insert Nursery <br />Schools and Day Care Centers on a conditional use basis in R-8 zones, <br />as provided on page 107, Section 9.7-19. <br /> <br /> UPON MOTION of Commissioner Nash, seconded by Commissioner Lentz <br />and unanimous!~ carried, the Board adopted the zoning text change as <br />presented. <br /> <br /> UPON MOTION of Commissioner Lentz, seconded by Commissioner Cook and <br />unanimously carried, the Board moved to go into Executive Session for <br />legal advice from the County Attorney. <br /> UPON MOTION of Commissioner Lentz, seconded by Commissioner Payne and <br />unanimously carried, the Executive Session was terminated. <br /> Mr. John R. Boger, Jr., County Attorney, reported that he had advised <br />the Board of his discussion with Mr. Lee Zachary, attorney representing <br />Mr. W. S. Chandler, Jr. He stated he would continue discussions with <br />Mr. Zachary concerning his notification that Mr. Chandler intends to <br />go through an appeals process with the hopes of resolving the matter. <br />Mr. Boger stated he would report to the Board again on Tuesday, September 7, <br />1982, after talking with Mr. Zachary on September 3. <br /> UPON MOTION of Commissioner Lentz, seconded by Commissioner Cook and <br />unanimously carried, the Board changed the time of the meeting scheduled <br />for Tuesday, September 7, 1982, from 9:30 A.M. to 7:00 P.M. <br /> UPON MOTION of Commissioner Payne, seconded by Commissioner Cook and <br />unanimously carried, the meeting was adjourned. <br /> <br />Clerk to the Board <br /> <br /> <br />
