187 <br /> <br /> The Board of Commissioners for the County of Cabarrus met in regular <br />session at the County Courthouse in Concord, North Carolina, on Monday, <br />November 1, 1982, at 9:30 A.M. <br /> Present - Chairman: Ralph C. Bonds <br /> Commissioners: J. Harold Nash <br /> Troy R. Cook <br /> James W. Lentz <br /> Kenneth F. Payne <br /> The invocation was given by Reverend Ron Crumpton of the First Assembly <br />of God Church of Kannapolis. <br /> UPON MOTION of Commissioner Cook, seconded by Commissioner Lentz and <br />unanimously carried, the minutes of October 18, 1982, were approved as <br />written. <br /> UPON MOTION of Commissioner Nash, seconded by Commissioner Payne and <br />unanimously carried, the Board approved the request from Mr. Randy Smith, <br />Marketing Director of Faison Associates, for a permit to have a pyrotechnics <br />display at the Charlotte Motor Speedway on Wednesday, November 3, 1982, <br />under the supervision of Southern International Fireworks, Inc. <br /> Mr. Wesley Grant, attorney representing Browning-Ferris Industries, <br />Inc., presented a request for. the transfer of the refuse collection <br />franchise area from Ray Helms Garbage Service to Browning-Ferris Industries, <br />Inc. Mr. Eric Black, District Manager of Browning-Ferris Industries, <br />Inc., reviewed the plans proposed by Browning-Ferris for the operation of <br />a franchise garbage collection service in Cabarrus County. These plans as <br />presented by Mr. Black included the establishment of a local facility, <br />the scheduling Qf regular service hours, the employment of qualified <br />personnel, the maintenance of a complaint logbook, and the utilization of <br />efficient equipment. <br /> Mr. William Fisher of J & F Disposal Company objected to the transfer <br />of the franchise area from Ray Helms to Browning-Ferris Industries, Inc., <br />stating that the transfer of this franchise area would violate the agreement <br />between Mr. Helms and J & F Disposal at the time of the original transfer <br />of the franchise area from J & F Disposal to Mr. Helms in 1981. He requested <br />postponement of the matter for thirty (30) days in order to confer with his <br />attorney. <br /> Mr. Fred Pilkington, Health Director, stated approval of the proposed <br /> transfer of the solid waste ordinance franchise rights from Mr. Ray Helms to <br /> Browning-Ferris Industries, Inc. <br /> UPON MOTION of Commissioner Payne, seconded by Commissioner Nash and <br /> unanimously carried, the Board granted the transfer of the franchise from <br /> Ray Helms Garbage Service to Browning-Ferris Industries, Inc. The following <br /> portion of Cabarrus County is granted unto Browning-Ferris Industries, Inc. <br /> <br />Said franchise is granted within the following boundaries: <br />Beginning at the intersection of Highway 601 and city limits <br />of Concord at Union Street South and runs thence down the <br />center of Highway 601 in a southerly direction to the Cabarrus- <br />Union County line, thence east following the county line to the <br />Stanly-Union-Cabarrus county lines, thence north along the <br />Cabarrus-Stanly county line to Rowan county line, thence west <br />following the Rowan county line to Old Salisbury Road, thence <br />south down the center of Old Salisbury Road to Brantley Road, <br />thence west down the center of Brantley Road to 1-85, thence <br />in a south-westerly direction down the center of 1-85 to the <br />point where the north-eastern Concord city limits intersects <br />with 1-85, thence south along the Concord city limits to the <br />beginning. <br /> <br /> Mr. Terry Rowland, Tax Supervisor, and Mr. W. P.
