204 <br /> <br />H. Mobile. Home Sales in Mobile Home Parks: <br /> <br />It shall be unlawful to sell on a commercial basis mobile homes <br />or trailers within mobile home parks unless the homes are to be <br />immediately occupied within the park. <br /> <br />I. Mobile Home Addition: <br /> <br />No living compartment other than a "Florida Room" or other such <br />prefabricated structure specifically designed by the manufacturer <br />for mobile home extension shall be added to any mobile home parked <br />in a mobile home park which is located within the jurisdiction of <br />this ordinance. The Board of Adjustment may grant a variance to <br />allow the addition of a living compartment other than that <br />designed by a mobile home manufacturer provided that plans for <br />the addition are submitted to the Board for approval and provided <br />that such plans meet the requirements of the applicable Building <br />Code of North Carolina. <br /> <br />J. Partial Invalidity: <br /> <br />If any provision or clause of these regulations affecting mobile <br />home(s) and/or mobile home parks in Cabarrus County shall be <br />declared invalid, such declaration shall not invalidate any other <br />provision or clause of said regulation. <br /> <br />K. Conflict with 0ther Ordinance and Regulations <br /> <br />When another applicable regulation, ordinance, or statute imposes <br />more restrictive regulations than these contained in this ordinance, <br />the more restrictive regulations shall govern. <br /> <br />L. Basic Steps to Follow in Mobile Home Ordinance <br /> <br />(1) <br /> <br />Mobile Home Park approval treated similar to subdivision <br />process. <br /> <br />(2) <br /> <br />Submit preliminary plat to Planning Department to be approved <br />by the Planning Board. <br /> <br />(3) <br /> <br />Approved preliminary plat goes to the Board of Adjustment <br />Conditional Use. <br /> <br />(4) <br /> <br />The final plat will contain elements of approved preliminary <br />plan and additional conditions of Board of Adjustment, <br />which will be presented to the Planning Board for final <br />approval. <br /> <br />If all improvements are not complete, a Performance Bond of Surety <br />must be posted for a period not to exceed one (1) year. In <br />extenuating circumstances burden of proof on the developer, an <br />extension may be granted by the Planning Board for a specific <br />number of months. Improvements must be completed prior to the <br />placement of any mobile home in a park. If all improvements are <br />not completed prior to the placement of mobile homes in a park, the <br />developer shall post a cash bond, obtain a surety bond, or a letter <br />of irrevocable credit from a bank lending institution appmoved by <br />the Planning Department. This bond will be in the amount of one <br />hundred thirty (130) percent of the cost as determined by the <br />Planning Department or a County Engineer or a Registered North <br />Carolina Civil Engineer working in conjunction with the county. <br /> <br />MOBILE HOME PARK REGULATIONS <br /> <br />APPENDIX I.
