215 <br /> <br />Permits for collection and transportation of solid waste shall be <br />issued for a one year period and may be renewable for similar periods. <br />Any permit may be revoked in the prescribed manner by the Health <br />Director for violation of regulations issued pertaining to the <br />management of solid waste materials. <br /> <br />Co <br /> <br />Whenever upon the inspection of facilities, equipment operating <br />methods of any person holding a permit to collect or to transport <br />solid waste, the Health Director finds that conditions or practices of <br />said permit holder are in violation of regulations pertaining to <br />management of solid waste, the Health Director shall give notice in <br />writing to such person of the nature of the violation. See Section <br />IX D, and Section XIII A. <br /> <br />De <br /> <br />No permit which~has been revoked or suspended shall be reinstated by <br />the Health Director until he finds, upon thorough inspection, that <br />all regulations pertaining to the management of solid waste have been <br />complied with. <br /> <br />SECTION IX - FRANCHISES <br /> <br /> No person shall collect and transport solid waste for a fee unless <br />such person holds a valid, current franchise issued by the County Commissioners <br />empowering him to so collect and transport solid waste. The franchise shall <br />define the holder's territory and may include the grant of an exclusive or <br />a non-exclusive commercial license in addition to the grant of an exclusive <br />residential license. <br /> <br />Ae <br /> <br />No franchise to collect and transport solid waste within Cabarrus County <br />shall be valid unless the franchise holder: <br /> <br />Holds a solid waste management permit issued by the Cabarrus <br />County Health Director to collect and transport solid waste; and <br /> <br />Files with the Health Director's office and County Manager's <br />office a schedule of his fees; and <br /> <br />Complies with all rules and regulations promulgated by the County <br />Commissioners and the Board of Health pertaining to solid waste <br />management. <br /> <br />B. Transfer and abandonment <br /> <br />No franchise shall be transferred by a holder without at least <br />30 days prior written notice to the Health Department and 'prior <br />approval by the County Commissioners. <br /> <br />No person shall abandon a franchise without at least 30 days <br />prior written notice thereof to the County Commissioners and the <br />Health Director. <br /> <br />Co <br /> <br />The franchise areas described in Exhibit A, which is attached hereto <br />and made a part hereof, being the franchise areas presently assigned <br />to the persons named therein, are hereby deemed to be effective, unless <br />terminated as provided herein. New or renewal franchises shall be <br />awarded for terms not exceeding five (5) years. <br /> <br />Termination and Suspension - Ail or any portion of a franchise may be <br />terminated or suspended for any of the following reasons by the <br />procedures provided in Article XIII hereof: <br /> <br />Termination of the Health Department solid waste management <br />permit; <br /> <br />Bo <br /> <br />Non-compliance with or violation of the maximum fee schedule <br />promulgated by the County Commissioners; <br /> <br />The attempted transfer of a franchise without prior written <br />approval of the County Commissioners; <br /> <br /> <br />
