223 The Board of Commissioners for the County of Cabarrus met in regular session at the County Courthouse in Concord, North Carolina, on Monday, December 20, 1982, at 7:00 P.M. Present - Chairman: J. Harold Nash Commissioners: Archie Y. Barnhardt Marcelle Milloway James W. Lentz Kenneth F. Payne The invocation was given by Reverend Worth Sweet, Associate Pastor of Central United Methodist Church. The minutes of December 6, 1982, were amended by Commissioner Milloway to correct the spelling of Ms. Lena Bowen's name on page 221. UPON MOTION of Commissioner Barnhardt, seconded by Commissioner Payne and unanimously carried, the minutes of December 6, 1982, were approved as amended. Mr. Terry Rowland, Tax Supervisor, was present to clarify the work that was taking place in his office and to answer any questions that had arisen since the reappraisal notices were mailed on December 18, 1982. He explained that the lapse of time from the date the notices were printed on December 11 and the date of the actual mailing had created the major problem. As the notices had specified a ten (10) day period from December 11 for scheduling appointments, many persons had thought that December 21 was the deadline for calling for appointments to appeal the reappraisal notice. Mr. Rowland reported that the revaluation firm had been inundated with telephone calls on December 20 and that persons had complained that the telephones had been taken off the hook when they had constantly received a busy signal throughout the day. Mr. Rowland also advised the Board that there would be a problem with parking at the time persons began coming to the Courthouse for the revaluation appeals. UPON MOTION of Commissioner Payne, seconded by Commissioner Barnhardt and unanimously carried, the Board extended the period for W. P. Ferriss Company, revaluation firm, to accept appointments regarding revaluation until February 1, 1983. At the request of Commissioner Barnhardt, Chairman Nash instructed Mr. Charles D. McGinnis, County Manager, to invite Sheriff Robert M. Canaday to be at the next Board meeting regarding Courthouse parking. UPON MOTION of Commissioner Payne, seconded by Commissioner Lentz and unanimously carried, the Board reappointed the Honorable Dwight W. Quinn as the General Assembly representative, to the Board of Directors of the Yadkin-Pee Dee River Basin Committee and appointed Chairman Harold Nash as the Commissioner representative and Councilman Laine Harling as the municipal representative from the City of Concord to serve on the Board of Directors of the Yadkin-Pee Dee River Basin Committee. The Board reviewed the request from Carolina Recycling of Concord for an exclusive solid waste permit/franchise to obtain Philip Morris' commercial roll-off container business and the recommendation~from Mr. Fred Pilkington, Health Director, for the granting of the franchise/permit conditioned on the company receiving the Philip Morris bid award. Mr. Pilkington explained that he had recommended the approval of the requested permit because the company was a local business based in Concord and had specifically asked to bid on a particular commercial account. Mr. Wesley B. Grant, attorney representing Browning-Ferris Industries (BFI) of South Atlantic, Inc., objected to the award of an exclusive solid waste permit/franchise to Carolina Recycling of Concord as that company did not hold a franchise for residential refuse collection in the county. He stated that a simila~ request from Browning-Ferris Industries had previously been denied by the Board and the company had purchased the residential franchise from Mr. Ray Helms in order to operate a refuse collection service in Cabarrus County. UPON MOTION of Commissioner Payne, seconded by Commissioner Lentz with Commissioners Payne, Lentz, and Milloway and Chairman Nash voting for and Commissioner Barnhardt voting against, the Board denied the request from Carolina Recycling of Concord and directed that the Health Department be advised that in the future this Board is leaning toward awarding a franchise to those people who pick up both residential and commercial garbage in Cabarrus County.
