<br /> UPON MOTION of Commissioner Payne, seconded by Commissioner Barnhardt
<br />and unanimously carried, the Board adopted the following resolution.
<br />
<br />RESOLUTION DECLARING AN INTENT
<br />TO ABANDON AND CLOSE TWO PORTIONS
<br />OF SIXTY (60) FOOT ROAD SHOWN
<br />ON PLAT RECORDED IN PLAT BOOK
<br />15, PAGE 41, CABARRUS COUNTY PUBLIC
<br />REGISTRY OFF TOM QUERY ROAD IN
<br />CABARRUS COUNTY, NORTH CAROLINA
<br />
<br /> WHEREAS, DMS MAY COMPANY, a North Carolina corporation, has petitioned
<br />the County of Cabarrus to close and abandon two certain port~ons of a sixty
<br />(60) foot road shown on a plat of The Kerr Industries property recorded in
<br />Plat Book 15, Page 41, Cabarrus County Public Registry ("the road"), a copy
<br />of which petition is available for inspection in the Office of the Clerk
<br />to the Board of Commissioners, Room 120, Cabarrus County Courthouse, Concord,
<br />North Carolina, and which two portions of the road are shown on survey
<br />prepared by Concord Engineering & Surveying, Inc., dated May 15, 1982,
<br />and which two portions of the road are more particularly described in
<br />Addendum A attached hereto and made a part hereof.

<br /> WHEREAS, the procedure for closing streets and public alleys as out-
<br />lined in Chapter 153A, Section 241, of the General Statutes of North
<br />Carolina, requires that Board of Commissioners adopt a Resolution declaring
<br />its intent to close the street or public alley and calling a public hearing
<br />on the question. The Statute further requires that the Resolution be
<br />published once a week for four (4) successive weeks prior to the hearing,
<br />a copy of the Resolution be sent by registered or certified mail to all
<br />owners of property adjoining the street or public alley as shown on the
<br />County Tax Records and a notice of the closing and public hearing be
<br />prominently posted in at least two (2) places along said street or public
<br />alley:

<br />WHEREAS, the Board of Commissioners desires to grant the Petition:
<br />
<br /> NOW, THEREFORE, BE IT RESOLVED AND DECLARED by the Board of Commissioners
<br />of the County of Cabarrus at its regularly scheduled session of March 21,
<br />1983, that it intends to close those two certain portions of a sixty (60)
<br />foot road shown on plat recorded in Plat Book 15, Page 41, Cabarrus
<br />County Public Registry, which two parcels of the road are shown on survey
<br />prepared by Concord Engineering & Surveying, Inc., dated May 15, 1982,
<br />a copy of which is available for inspection in the office of the Clerk of
<br />the Board of Commissioners in Room 120 of the Cabar~us County Courthouse,
<br />at Concord, North Carolina, and which portions of the road are more
<br />particularly described in Addendum A attached hereto and made a part hereof,
<br />and the Board of Commissioners hereby calls a public hearing on the
<br />question to be held at 8:30 P.M. on Monday, the 18th day of April, 1983,
<br />at the Commissioners' Meeting Room in the Cabarrus County Courthouse. The
<br />Clerk to the Board of Commissioners is hereby directed to publish a copy
<br />of this Resolution in the Concord Tribune once a week for four (4)
<br />successive weeks next preceding the date herein for such hearing; and the
<br />Petitioner is directed to send by registered or certified mail a copy of
<br />this Resolution to all owners of property adjoining the portions of the
<br />road shown on the County Tax Records and to prominently post a notice of
<br />the closing and public hearing in at least two (2) places along the road
<br />all as required by the provisions of Chapter 153A, Section 241, of the
<br />General Statutes of North Carolina.
