265

Mr. James L. Pharr, Fire Marshal, reported that the Cabarrus County
Fire Chief's Association had agreed to purchase 100 gallons of fire
fighting foam concentrate on a match basis with Cabarrus County. He ex-
plained that each department will pay $52.64 toward the $1,000.00 match
with the foam to be stored at Concord Fire Station No. 1. Mr. Pharr advised
the Board that approximately 500 to 1,000 gallons of foam concentrate is
needed in order for Cabarrus County to have an adequate supply of the
fire fighting foam.
UPON MOTION of Commissioner Payne, seconded by Commissioner Lentz and
unanimously carried, the Board moved to go into Executive Session to
discuss legal matters and the acquisition of land.
UPON MOTION of Commissioner Payne, seconded by Commissioner Lentz and
unanimously carried, the Executive Session was terminated.
Chairman Nash reported that the Board had discussed a legal matter
and land acquisition during the Executive Session. He stated that no
action was taken on the matter of land acquisition.
UPON MOTION of Commissioner Payne, seconded by Commissioner Lentz and
unanimously carried, the Board moved that the County Attorney prepare a
Complaint seeking an injunction against Charlotte concerning tipping fees
at the landfill located at the Charlotte Motor Speedway and that the Chairman
of the Board sign the Complaint.
Mr. Manuel Kiser expressed concern that the amendment to the Solid
Waste Ordinance prohibiting tipping fees for landfills in the county
would prevent him from charging fees for the use of his demolition
landfill in the future if he desired to do so. He asked that the Board
seriously consider the matter before bringing legal proceedings against
the City of Charlotte concerning tipping fees at the landfill at the
Charlotte Motor Speedway.
UPON MOTION of Commissioner Letnz, seconded by Commissioner Payne and
unanimously carried, the meeting was adjourned.

Clerk to the Board
