274 <br /> <br /> WHEREAS, no persons, firms or corporations or parties in interest <br />have appeared in opposition to the closing of the tWo portions of the <br />road; <br /> <br /> THEREFORE, BE IT RESOLVED, by the Board of Commissioners of the <br />County of Cabarrus, North Carolina: <br /> <br />That the Board of Commissioners hereby orders the closing of <br />those two certain portions of that certain sixty (60) foot road <br />shown on plat recorded in Plat Book 15, Page 41, CabarrUs County <br />Public Registry ("the road"), which two portions of the road are <br />shown on a survey prepared by Concord Engineering & Surveying, <br />Inc., dated May 15, 1982, a copy of which shall~be duly recorded <br />in the Cabarrus County Public Registry and which is made a part <br />hereof by'reference thereto, and which two portions of the road <br />are more particularly described in Addendum A attached hereto and <br />made a part hereof, and it appearing to the satisfaction of the <br />Board of Commissioners that the closing of those'two portions of <br />the road is not contrary to the public interest and that no individual, <br />firm or corporation owning property in the vicinity thereof will be <br />deprived of reasonable means of ingress and egress to his or its <br />property. <br /> <br /> BE IT FURTHER RESOLVED that a certified copy of this Resolution be <br />filed in the office of the Register of Deeds for Cabarrus County, North <br />Carolina. <br /> <br />Approved as to form: <br /> <br />/s/ John R. Boger, Jr. <br /> <br />County Attorney <br /> <br /> ADDENDUM A <br />PARCEL I : <br />Lying and being in NO. 1 Township, Cabarrus County, North Carolina, <br />within a sixty foot road right-of-way and more particularly described <br />as follows: <br /> <br />BEGINNING at a point in Tom Query Road, the northwesterly corner of <br />Tract 1 as shown on Plat recorded in Plat Book 15, Page 41, Cabarrus <br />County Public Registry ("Recorded Plat"), which point of BEGINNING is the <br />northernmost point in that certain sixty foot road right-of-way shown on <br />the Recorded Plat and described in that certain Declaration of Dedication <br />recorded in Book 445, Page 627, Cabarrus County Public Registry; and runs <br />thence from the BEGINNING seven (7) courses and distances with the westerly <br />or southwesterly boundary of Tract 1 and the easterly or northeasterly <br />margin of the sixty foot road, both as shown on the Recorded Plat, as <br />follows: (1) S. 46-06-48 ~E. 227.11 feet to a point; (2) S. 52-41-58 <br />E. 163.27 feet to a point; (3) S. 38-51-58 E. 106.35 feet to a point; <br />(4) S. 28-31-53 E. 133.19 feet to a point; (5) S. 23-27-28 E. 150.61 feet <br />to a point; (6) $. 42-58-08 E. 203.03 feet to a point; and (7) S. 29-46-03 E <br />126.09 feet to a point at the southwesterly corner of Tract 1 and the <br />northwesterly corner of Tract 2 as shown on the Recorded Plat; thence S. <br />60-13-57 E. '60.04 feet to a point in the northeasterly boundary of Tract 3 <br />and the westerly or southwesterly margin of the right-of-way of the sixty <br />foot road, both as shown on the Recorded Plat; thence with the northeasterly <br />boundary of Tract 3 and the westerly or southwesterly margin of the right- <br />of-way of the sixty foot road, both as shown on the Recorded Plat, two (2) <br />courses and distances as follows: (1) N. 29-46-03 W. 119.53 feet to a point and <br />(2) N. 42-58-08 W. 206.41 feet to a point at the northernmost corner of <br />Tract 3 and the easternmost corner of Tract 4 as shown on the Recorded Plat; <br />thence with the northeasterly boundary of Tract 4 as shown on the Recorded <br />Plat and continuing with the westerly or southwesterly margin of the right- <br />of-way of the sixty foot road shown on the Recorded Plat five (5) courses <br />and distances as follows: (1) N. 23-27-28 W. 158.27 feet to a point; <br />(2) N. 28-31-53 W. 125.11 feet to a point; (3) N. 38-51-58 W. 93.65 feet <br />to a point; (4) N. 52-41-58 W. 159.45 feet to a point; and (5) N. 46-06-48 <br /> <br /> <br />
