Harold Nash <br /> <br /> Mr. James M. Whitley, President of Whitley Motor Company, Inc., <br />complained that his property had been incorrectly mapped by the County <br />Mapping Department and, as a result of the mapping error, the property <br />had not been zoned properly at the time the Zoning Ordinance and Atlas <br />were adopted. He explained that he had been denied a building permit to <br />add on to an existing building because that part of his property was <br />incorrectly zoned residential and asked that the Board correct the zoning <br />error. <br /> The Board referred Mr. Whitley's request for Correction of the Zoning <br />Atlas error to the Planning Board. <br /> Mr. W. B. Murray of 2005 Carolina Avenue in Kannapolis complained <br />that he was unable to build a carport'on the rear of his existing garage <br />as it would not meet the 10-foot setback requirement stipulated by the <br />Zoning Ordinance. He specifically objected to the $100.00 filing fee for <br />a'variance from the Board of Adjustment. <br /> The motion by Commissioner Barnhardt and seconded by Chairman Nash <br />to waive the $100.00 charge for Mr. W. B. Murray to apply for a variance <br />to the Board of Adjustment failed with Commissioner Barnhardt and Chairman <br />Nash voting for and Commissioners Lentz, Payne, and Milloway voting against. <br /> The Board took no action in the matter and recommended that Mr. W. B. <br />Murray petition the Board of Adjustment for a variance in order to construct <br />the carport on his property. <br /> The Board received a petition from Jon R. and Sadie B. Finger and <br />Marshall L. and Eva M. Cheek for the closing of the section of Coventry <br />Road described as follows. <br /> <br />BEGINNING at an old iron stake, corner of Marshall Cheek, this <br />stake being in the northern edge of Coventry Road at the point <br />where it makes a right-angle turn to the north, and runs thence <br />along the northern edge of the unopened roadway along the line <br />of Marshall Cheek, North 85-56 East 308.8 feet to an iron stake <br />on the western edge of Azalea Avenue; thence along Azalea Avenue <br />and the unopened end of Coventry Road, South 5-12 West 50.17 feet <br />to a stake; thence South 15-31 West 11.1 feet to a stake in the <br />unopened section of Coventry Road; thence along the southern edge <br />of the unopened section of Coventry Road, South 85-56 West 308.8 <br />feet, more or less, to a point; thence across the western end of <br />the unopened segment of Coventry Road, North 0-29 West 60 feet, more <br />or less, to the point of Beginning. <br /> <br /> UPON MOTION of Commissioner Lentz, seconded by Commissioner Payne and <br />unanimously carried, the Board adopted the following resolution. <br /> <br /> BE IT RESOLVED by the Board of Commissioners for Cabarrus <br />County. North Carolina, that: <br /> <br /> The Board of Commissioners, having received a petition, which <br />petition is on file with the Clerk of the Board, requesting that <br />the segment of Coventry Road described in the petition be closed, <br />does hereby declare its intent to close that segment of Coventry <br />Road located in Number Four Township, Cabarrus County, North <br />Carolina, as is described in the petition, and does hereby set <br />the 16th day of May, 1983, at 7:30 o'clock p.m., in the Commissioners <br />Room of the Cabarrus County Courthouse as the time and place at <br />which it will hold a public hearing on this resolution of intent. <br /> <br /> UPON MOTION of Commissioner Barnhardt, seconded by Commissioner <br />Milloway and unanimously carried, the Board moved to go into Executive <br />Session regarding the acquisition of property. <br /> <br /> <br />
