297 <br /> <br />lawful meetings on May 13, 1983, each of the Constituent Boards approved <br />and adopted a plan of merger and consolidation of the Concord City School <br />Administrative Unit and the Cabarrus County School Administrative Unit <br />(the "Plan of Merger"), an executed copy of which is attached hereto; <br /> <br /> WHEREAS, the Constituent Boards have certified that a public hearing <br />on the Plan of Merger was announced on May 13, 1983, for May 24, 1983, and <br />have further certified that the public hearing on the Plan of Merger was <br />duly held on said date; <br /> <br /> WHEREAS, the Constituent Boards have submitted the Plan of Merger to <br />the Board of Commissioners for Cabarrus County, North Carolina, and the <br />Plan of Merger has been considered by the Board of Commissioners for <br />Cabarrus County, North Carolina, at a special meeting on May 26, 1983. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED that the Board of Commissioners for <br />Cabarrus County, North Carolina, concurs in and approves the Plan of <br />Merger of the Concord City School Administrative Unit and the Cabarrus <br />County School Administrative Unit hereinbefore referred to; and the <br />Chairman and Clerk are authorized and directed to execute and deliver all <br />documents and agreements necessary to accomplish the same. <br /> <br />BOARD OF COMMISSIONERS OF <br />CABARRUS COUNTY <br /> <br />By: /s/ J. Small <br /> <br />Clerk <br /> <br />The approved Plan of Merger is as follows. <br /> <br />NORTH CAROLINA <br /> <br />CABARRUS COUNTY <br /> <br /> The undersigned CONCORD CITY BOARD OF EDUCATION (the "City Board") <br />and the CABARRUS COUNTY BOARD OF EDUCATION (the "County Board") (The City <br />Board and the County Board being sometimes referred to collectively as <br />the "Constituent Boards") hereby execute this plan of consolidation and <br />merger for purposes of merging said Boards into a single Board of <br />Education pursuant to the provisions of North Carolina General Statutes <br />Section 115C-67: <br /> <br /> 1. Plan of Merger. On the Effective Date, the Concord City School <br />Administrative Unit and the Cabarrus County School Administrative Unit <br />shall be merged into a single unit and the City Board and the County <br />Board shall be merged into a single Board. <br /> <br /> 2. Name. The name of the merged school administrative unit shall be <br />the Cabarrus County School Administrative Unit (the "Merged Unit") and <br />the name of the Board of Education to administer the merged school unit <br />shall be the Cabarrus County Board of Education (the "Merged Board"). <br /> <br /> 3. Effective Date. Provided all of the conditions set forth herein <br />are accomplished, the effective date of the merger and consolidation of <br />the units and boards contemplated herein shall be 12:01 A.M. Eastern <br />Daylight Time, July 1, 1983 (the "Effective Date"). <br /> <br /> 4. Establishment and Maintenance of Merged Board. Upon the Effective <br />Date the boundary lines of the Merged Unit (the "Merged Unit boundary lines") <br />shall extend to and include that geographic area of Cabarrus County, North <br />Carolina served by and encompassed within the Concord City School Adminis- <br />trative Unit and~the Cabarrus County School Administrative Unit and the <br />Constituent Boards shall be and become the Merged Board established and <br />maintained as follows: <br /> <br />a. The Merged Board shall consist of seven (7) members with seats <br />on the Merged Board numbered one (1) through seven (7). <br /> <br /> <br />
