366 <br /> <br />Section 2. <br /> <br />That this resolution be adopted by the City Council of <br />the City of Concord and that a copy be given to the <br />Chairman of the County Board of Commissioners. <br /> <br /> The foregoing resolution, having been submitted to a vote, received <br />the following vote: <br /> <br /> AYES <br />Councilman Laine Harling <br />Councilman Jim Dorton <br />Councilman Frank Dusch <br />Councilman Robert Mathis <br />Councilman C. Weant, City Clerk <br /> <br /> There being no one else present wishing to speak, Chairman Nash <br />terminated the public hearing at 7:55 P.M. <br /> The motion by Commissioner Milloway and seconded by Commissioner <br />Barnhardt to submit the question of levying the one-half percent (1/2%) <br />supplemental sales tax to a referendum at the spring primary failed with <br />Commissioners Barnhardt and Milloway voting for and Commissioners Payne and <br />Lentz and Chairman Nash voting against. <br /> UPON MOTION of Commissioner Payne, seconded by Commissioner Lentz with <br />Commissioners Payne and Lentz and Chairman Nash voting for and Commissioners <br />Barnhardt and Milloway voting against, the Board adopted the following <br />Resolution. <br /> <br />A .RESOLUTION LEVYING A ONE-HALF PERCENT (1/2%) SUPPLEMENTAL LOCAL GOVERNMENT <br />SALES AND USE TAX AND PRESCRIBING THE METHOD OF DISTRIBUTION OF THE PROCEEDS <br />WITHIN CABARRUS COUNTY. <br /> <br /> WHEREAS, a public hearing was held on August 31, 1983, to consider the <br />levy of a one-half percent (1/2%) supplemental local government sales and <br />use tax, and interested citizens presented their views to'the Board of County <br />Commissioners; and <br /> <br /> WHEREAS, the Board of County Commissioners caused public notice of the <br />public hearing to be given in accordance with law at least ten days prior <br />to the date of the hearing; and <br /> <br /> WHEREAS, the Board of Commissioners of Cabarrus County is now of the <br />opinion and does hereby find and declare that the levy of said sales tax <br />within Cabarrus County is both desirable and necessary to adequately finance <br />the operation of the county and the cities and towns herein; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of <br />Cabarrus County as follows: <br /> <br /> Section 1. There is hereby imposed and levied within Cabarrus County <br />the one-half percent (1/2%) supplemental local government sales and use <br />tax authorized by Ratified Chapter 908 of the 1983 Session Laws, and codified <br />as Article 40 of Chapter 105 of the General Statutes of North Carolina, <br />effective July 21, 1983. The tax hereby imposed and levied shall apply to the <br />same extent and be subject to the same limitations as are set forth in said <br />Chapter 908. <br /> <br /> <br />
