373 <br /> <br /> Fifth. The Employer agrees to pay special contributions for a minimum <br /> twenty-four (24) consecutive months following the month of this AGREEMENT, <br /> but may cease such contributions upon written notice to the Retirement <br /> System; provided, if the Employer elects to cease special contributions, <br /> the Retirement System shall not enter into a~y further AGREEMENT with the <br /> Employer for a period of twelve (12) consecutive months from the month of <br />· cessation; and further, it is mutually agreed by the Retirement System and <br /> the Employer that payment and acceptance of special contributions for the <br /> first month following the twenty-four (24) consecutive months following the <br /> effective date of this AGREEMENT shall in itself be an AGREEMENT to continue <br /> to pay and accept special contributions until the Employer elects to cease <br /> special contributions by written notice to the Retirement System as herein <br /> provided. <br /> <br /> Sixth. The Retirement System agrees to issue a Letter of Credit to the <br />Employer each month in which a member or members for whom the Employer has <br />paid special contributions withdraws accumulated regular contributions or <br />dies without eligibility for a survivor's alternate benefit, in an amount <br />or amounts equal to such special contributions previously paid by the <br />Employer; and, the Employer agrees to utilize the Letter of Credit so issued <br />to satisfy and pay any obligation owing to the Retirement System. <br /> <br /> Seventh. It is mutually agreed by the Retirement System and the Employer <br />that the first, second, third and sixth sections above apply equally to <br />all special contributions paid by the Employer prior to the effective date <br />of this AGREEMENT. <br /> <br /> IN WITNESS HEREOF, the County of Cabarrus, pursuant to a resolution <br />adopted by its governing body on the 6th day of September, 1983, has caused <br />this instrument to be executed on its behalf by its Chairman, to be attested <br />by its Clerk and its seal to be hereto affixed all as of the day and year <br />written above, and to be executed in duplicate. <br /> <br />For the Employer: <br /> /s/ J. Small (Seal) <br /> <br />Clerk <br /> <br />Witness: <br /> <br />(Seal) <br /> <br /> UPON MOTION of Commissioner Payne, seconded by Commissioner Lentz and <br />unanimously carried, the Board approved the addition of Weldon Circle and <br />Andover Street to the State secondary road system. <br /> Mr. John R. Boger, Jr., County Attorney, suggested postponement of <br />consideration of the proposed Water Supply Agreement between Cabarrus County <br />and the Board of Light and Water Commissioners of the City of Concord until <br />the next meeting to allow him time to determine if the proposed agreement <br />is in conformance with an agreement required by the Farmers Home Administration. <br /> UPON MOTION of Commissioner Lentz, seconded by Commissioner Barnhardt <br />and unanimously carried, the Board deferred consideration of the Water <br />Supply Agreement until the next meeting. <br /> UPON MOTION of Commissioner Barnhardt, seconded by Commissioner Lentz <br />and unanimously carried, the Board authorized Mr. Charles D. McGinnis, <br />County Manager, and Mr. John R.
