375 <br /> <br /> Chairman Nash stated that this was the day and hour scheduled for a <br />public hearing to determine finally whether the assistance in financing <br />the improvements for Groff Street would be made and asked if anyone were <br />present who wished to speak for or against these road improvements under <br />the participative paving program. <br /> Mr. John H. Jones, owner of property located on Groff Street, objected <br />to the paving of that street under the participative paving program. He <br />stated he had been paying taxes for thirty (30) years and that the paving <br />of the street should be done at no cost to him. <br /> Mr. Charles H. Willis, resident of Groff Street, stated that he had <br />paid his portion of the participative paving costs as well as a portion of <br />Mr. Jones's costs and was in favor of the road being paved as soon as <br />possible. <br /> UPON MOTION of Commissioner Lentz, seconded by Commissioner Payne and <br />unanimously carried, the Board adopted the following resolution. <br /> <br /> RESOLUTION AUTHORIZING ASSISTANCE <br /> IN THE FINANCING OF IMPROVEMENTS TO <br />RURAL SUBDIVISION AND RESIDENTIAL STREETS <br /> <br /> WHEREAS, The Board of County Commissioners on August 15, 1983, <br />adopted a preliminary resolution giving notice of intention to assist <br />in the financing of improvements to rural subdivision and residential <br />streets; and <br /> <br /> WHEREAS, due notice has been given that on the 6th day of September, <br />1983, at 10:00 A.M. in the Commissioners' Room in the Cabarrus County Court- <br />house, held on whether the assistance in financing the road improvements <br />hereinafter described shall be made and that all objections to the legality <br />of the making of such financial assistance are required by law to be made <br />in writing, signed in person or by an attorney, and filed with the Clerk <br />to the Board at or before the time of the public hearing; and <br /> <br /> WHEREAS, the public hearing has now been held and any objections <br />made concerning the financial assistance were considered; <br /> <br /> NOW, THEREFORE BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF <br />THE COUNTY OF CABARRUS: <br /> <br /> 1. That the street or streets, road or roads, or rights of way <br />herein set out are without paving, and public interest requires that asphalt <br />paving be made available, and that abutting property will be benefitted <br />to the extent of the part of the cost thereof to be assessed against such <br />abutting property. <br /> <br /> 2. If the local improvements are ordered made by the North Carolina <br />Department of Transportation, the County of Cabarrus shall remit to the <br />North Carolina Department of Transportation the proportion of the cost <br />thereof representing the total local share as required by policies of the <br />North Carolina Department of Transportation's Secondary Road Council. <br /> <br /> 3. That the local improvements to be made on the street or streets, <br />road or roads, or right of way, set out above are as follows: <br /> <br /> ASPHALT PAVING SECONDARY ROAD NUMBER STREET OR ROAD <br /> SR 1420 Groff Street <br /> <br /> 4. That the proportion of the cost of the improvements to be assessed <br />against the abutting property and the terms of payment will be as provided <br />in the Notice of Public Hearing which was served on the owners of the <br />property to be assessed. <br /> <br />DATE: September 6, 1983 <br /> <br />ATTEST: <br />Clerk to the Board of County <br />Commissioners <br /> /s/ Frankie F.
