398 UPON MOTION of Commissioner Lentz, seconded by Commissioner Payne and unanimously carried, the Board approved the Cabarrus County Disaster Relief and Assistance Plan as presented by Mr. Ben Mabrey and authorized Chairman Nash to sign the approved plan on behalf of the Board of Commissioners. UPON MOTION of Commissioner Lentz, seconded by Commissioner Payne and unanimously carried, the Board approved the following agreement between the Town of Harrisburg and Cabarrus County. STATE OF NORTH CAROLINA COUNTY OF CABARRUS AGREEMENT THIS AGREEMEMT, entered into this __ day of , 1983, by and between the Town of Harrisburg, a municipal corporation, State of North Ca~ol±na (the "Town"), party of the first part; and the County of Cabarrus, State of North Carolina (the "County"), party of the second part; W I TN E S S E TH: WHEREAS, the County of Cabarrus has a vested interest up to 4.0 million gallons per day of treatment capacity in the Rocky River Regional Wastewater Treatment Plant. WHEREAS, the County of Cabarrus will own and operate an interceptor pipeline from Harrisburg to the Rocky River Regional Wastewater Treatment Plant upon the completion of the proposed interceptor pipeline, and that the County intends to transport wastewater for Harrisburg to the treatment plant for treatment. NOW, THEREFORE, for and in consideration of the premises, the mutual promises, and covenants herein contained, and the mutual benefits flowing to the parties hereunder, the parties hereby agree and contract as follows: 1. That upon completion of the proposed interceptor pipeline from Harrisburg to the Rocky River Regional Wastewater Treatment Plant the County of Cabarrus will transport through said interceptor pipeline Harrisburg's wastewater to the treatment plant for treatment according to rules established by the County.
