398 <br /> <br /> UPON MOTION of Commissioner Lentz, seconded by Commissioner Payne and <br />unanimously carried, the Board approved the Cabarrus County Disaster Relief <br />and Assistance Plan as presented by Mr. Ben Mabrey and authorized Chairman <br />Nash to sign the approved plan on behalf of the Board of Commissioners. <br /> UPON MOTION of Commissioner Lentz, seconded by Commissioner Payne and <br />unanimously carried, the Board approved the following agreement between <br />the Town of Harrisburg and Cabarrus County. <br /> <br />STATE OF NORTH CAROLINA <br />COUNTY OF CABARRUS <br /> <br />AGREEMENT <br /> <br /> THIS AGREEMEMT, entered into this __ day of , 1983, by and <br />between the Town of Harrisburg, a municipal corporation, State of North <br />Ca~ol±na (the "Town"), party of the first part; and the County of Cabarrus, <br />State of North Carolina (the "County"), party of the second part; <br /> <br />W I TN E S S E TH: <br /> <br /> WHEREAS, the County of Cabarrus has a vested interest up to 4.0 million <br />gallons per day of treatment capacity in the Rocky River Regional Wastewater <br />Treatment Plant. <br /> <br /> WHEREAS, the County of Cabarrus will own and operate an interceptor <br />pipeline from Harrisburg to the Rocky River Regional Wastewater Treatment <br />Plant upon the completion of the proposed interceptor pipeline, and that <br />the County intends to transport wastewater for Harrisburg to the treatment <br />plant for treatment. <br /> <br /> NOW, THEREFORE, for and in consideration of the premises, the mutual <br />promises, and covenants herein contained, and the mutual benefits flowing <br />to the parties hereunder, the parties hereby agree and contract as follows: <br /> <br /> 1. That upon completion of the proposed interceptor pipeline from <br />Harrisburg to the Rocky River Regional Wastewater Treatment Plant the <br />County of Cabarrus will transport through said interceptor pipeline <br />Harrisburg's wastewater to the treatment plant for treatment according to <br />rules established by the County. <br /> <br /> IN TESTIMONY WHEREOF, the parties have caused this instrument to be <br />duly executed pursuant to authority duly given, the day and year first above <br />written. <br /> <br />ATTEST: <br /> <br />THE TO!~N OF HARRISBURG <br />By: <br /> <br />Mayor <br /> <br />Town Clerk <br /> <br />PARTY OF THE FIRST PART <br /> <br />ATTEST: <br /> /s/ Frankie F.
