423 <br /> <br /> Mr. James Owens informed the Board that he had received a telephone <br />message from Mr. Stegall that date stating that the land owner had given <br />him written permission to rezone the entire 2.25 acres of land which would <br />allow sufficient space requirements for a used car lot he planned to establish <br />on the property. Mr. Owens explained that a new request for rezoning would <br />be presented to the Planning Board at a later date for consideration. <br /> UPON MOTION of Commissioner Milloway, seconded by Commissioner Lentz <br />and unanimously carried, the Board referred Petition 83-25 back to the <br />Planning Board. It was noted that a new rezoning request by Mr. Stegall <br />for the property would require a new map and new application. <br /> <br />(5) <br /> <br />Marvin & Donald Widenhouse, Petition 83-26, Highway 601 & 24-27. <br />Township 10, 5555-20-6464. Wishes to rezone from C-2 to RMF-6. <br />Applicants withdrew application October 17, 1983. Application <br />withdrawn after Planning Board had denied the rezoning request. <br /> <br /> The Board of Commissioners acknowledged that the Petition had been <br />withdrawn by letter dated October 17, 1983, from Mr. James E. Scarbrough, <br />attorney. <br /> <br />(6) <br /> <br />Richard & Kathy Barnhardt, Petition 83-27, end of Michigan Street <br />and Kentucky Street. Township 4, 5622-36-2313. Wishes to rezone <br />from R-40 to R-9. Planning Board voted in favor of the rezoning <br />request. <br /> <br /> Mr. Richard Barnhardt stated that he had spoken with Mr. W. S. Chandler, <br />former Planning Director, on two occasions and Mr. F. E. Isenhour, Zoning <br />Administrator, on one occasion regarding the classification of the land and <br />had been told that the property was zoned R-9. He stated that it was not <br />until he submitted the preliminary plat for the property that he was told <br />that the land was zoned R-40 and not R-9. Mr. Barnhardt requested that his <br />property be rezoned and that the $175.00 rezoning application fee be refunded. <br /> UPON MOTION of Commissioner Milloway, seconded by Commissioner Barnhardt <br />and unanimously carried, the Board moved to uphold the Planning Board's vote <br />approving Petition 83-27 to rezone 7.074 acres of land in Township 4, <br />Map/PIN 5622-36-2313, from R-40 to R-9. <br /> UPON MOTION of Commissioner Milloway, seconded by Commissioner Lentz <br />with Commissioners Milloway, Lentz, and Barnhardt and Chairman Nash voting for <br />and Commissioner Payne voting against, the Board agreed to refund the <br />$175.00 rezoning application fee to Mr. Richard Barnhardt. <br /> <br />(7) <br /> <br />Robert E. Satterfield, Petition 83-28, off of Pitt School Road. Township 2, <br />5509-16-4177. Wishes to rezone from R-40 to ARR. Planning Board approved <br />rezoning request. <br /> <br /> Mr. Robert E. Satterfield, property owner, stated he wished to bring <br />the existing garage into conformance in order to proceed with his plans to <br />sell the garage. <br /> UPON MOTION of Commissioner Barnhardt,~seconded by Commissioner Payne and <br />unanimously carried, the Board approved Petition 83-28 to rezone 5509-16-4177 <br />from R-40 to ARR. <br /> <br />(8) <br /> <br />Precision Interlock Log Homes, Inc., Petition 83-29, Lumber Lane off <br />of Goldfish Road. Township 5, 5634-71-6213. Wishes to rezone from <br />R-30 to ARR. Planning Board approved rezoning request. <br /> <br /> Mr. Chris Hoff, representative of Precision Interlock Log Homes, Inc., <br />requested the rezoning to bring the existing building into conformance to <br />permit expansion of the building. <br /> UPON MOTION of Commissioner Milloway, seconded by Commissioner Lentz <br />and unanimously carried, the Board moved to uphold the Planning Board's <br />approval of Petition 83-29 to rezone 5634-71-6213 from R-30 to ARR. <br /> <br />PROPOSED SUBDIVISION ORDINANCE AMENDMENT <br /> <br /> Mr. F. A.
